Interim Measures on Construction and Management of Jing'an Feature Streets

Chapter 1 General Provisions

Article 1. With an aim to further enhance quality and economic value in the construction and development of feature streets, better serve the improvement of the overall function, image, service quality and competence in the development for Nanjing Road Commercial Business Blocks and provide solid support for accelerating the building of Jing'an District into an international business port, these Interim Measures are formulated according to the relevant documents and the characteristics of Jing'an District.

Article 2. Feature streets refer to the regional commercial blocks consisting of the entire characteristic commercial services infrastructure connected with or adjacent to Nanjing Road in Jing'an District. At present, feature streets in Jing'an District mainly include Weihai Road Culture and Media Street, Wujiang Road Leisure Street, Julu Road European-styled Street, Backstreet of “Mei-Tai-Heng” (Meilongzhen Plaza, Citic Square, and Plaza 66), Time-honored Trade Name Feature Street, and Tongren Road Catering and Leisure street.

Article 3. These Measures apply to the construction and management of the feature streets in the scope of all the Jing'an District. The Joint Conference Office for the construction and management of the feature streets is responsible for the organization of the implementation of these measures. All the relevant departments and units are required to properly fulfill their duty of proving services or conducting management according to their responsibilities to support the construction and development of the feature streets.

Chapter 2 Management System and Responsibilities

Article 4. The management system of Jing'an District consists of the District Joint Conference for Construction and Management of Feature Streets, District Joint Conference Office for Construction and Management of Feature Streets, Administrative Departments for Construction and Management of Feature Streets (with the short description of “Administrative Department”) and the their affiliated offices as well as the membership units of the Joint Conference for Construction and Management of Feature Streets.

Article 5. Responsibilities of District Joint Conference for Construction and Management of Feature Streets (with the short description of “Joint Conference”) mainly include:

(1). Responsibility for the discussion of the development strategy and plan for the feature streets in Jing'an District;

(2). Responsibility for the discussion and decision on the significant issues including the general planning, function positioning, supporting policies and comprehensive management for the feature streets;

(3). Responsibility for the discussion of the formulation and realization of the annual achievement goal of the construction and management of the feature streets as well as the conduction of relevant evaluation and assessment;

(4). Responsibility for coordination and decision-making concerning the significant issues in the promotion of the feature streets.

Article 6. Chief Caller and Assistant Caller of the Joint Conference will be assumed respectively by the District Governor and one appointed Vice District Governor. Members of the Joint Conference include heads of the District General Office, District Development and Reform Commission, the District Commission of Commerce, District Diplomatic Relations Committee, District Science and Technology Commission, District SASAC, District Finance Bureau, the District Environmental Protection Bureau, District Land Planning Bureau, District Forestation and Amenity Bureau, District Housing Management Bureau, District Tourism Bureau, Jing'an Branch of Shanghai Public Security Bureau, Jing'an Branch of Shanghai Administration of Taxation, Jing'an Branch of Shanghai Administration for Industry and Commerce, District Investment Office, District Bureau of Supportive Management for Municipal Projects, District Afforestation Bureau, leading units in the construction and management of feature streets, and enterprises.

Article 7. The Joint Conference office is located at the General Office of the District Government, the Director and the Vice Director of which will be respectively assumed by the Director and the Vice Director of the General Office of the District Government. The main responsibility of Joint Conference office is the key work in the construction of the feature streets and the coordination, services and supervision in the significant issues involved, according to the decisions of the Joint Conference, which mainly include:

(1). Leading in the formulation of the “General Planning Scheme for Construction of Jing'an District Feature Streets”;

(2). Coordinating for the compilation of the detailed planning scheme of the construction of the feature streets;

(3). Collecting the annual work plans for the construction of the feature streets and arrangement for the relevant projects;

(4). Reinforcing the supervision of the relevant work and collect relevant information in the working progress and the construction work of the feature streets;

(5). Responsibility for the deployment of the decisions made by the Joint Conference and the coordination between the Administrative Departments, the Joint Conference and other relevant functional departments;

(6). Responsibility for coordination between relevant departments to build the information platform “On-line Feature Streets”, thus realizing the functions including resources sharing and information display of the feature streets in the district.

Article 8. The system of Project Responsibility will be applied to the construction of feature streets. Construction administrative departments centering on the feature streets as main bodies will be established, whose chief administrator will be assumed by a Vice District Governor responsible for a certain feature street, with members including the major enterprises for the construction and management as well as relevant departments in the district. The major construction enterprises will be the leading units in the construction of feature streets, which will be directly responsible to the Vice District Governor. The main duties of the administrative departments is to conduct the comprehensive management of its assigned feature street, as well as guide the office of administrative department for corresponding feature street to promote the progress of all the working tasks. They include:

(1). Responsibility for preliminary examination upon the scheme of the detailed development plan based on the function and image of the feature street confirmed on the Joint Conference and the actual condition;

(2). Responsibility for the plan progress in the construction of its assigned feature street and clarification of the goal in the different stages, working requirements and time lines;

(3). Responsibility for the researches and suggestions of the supporting policies and measures in the development of the feature street and submit them to the Joint Conference for further discussion as well as coordinate between relevant departments to implement them;

(4). Responsibility for the communication between the responsible units, relevant functional departments and business conductors, as well as coordination for the key issues and difficulties in the construction of the feature street;

(5). Responsibility for the confirmation, promotion and following-up in the progress of the annual workload of the feature street as well as the implementation of the following-up, midway examination and promotion of the office working plan of the administrative department for the feature street, with an aim to insure the accomplishment of the annual working aim;

(6). Responsibility for the convening of the routine meeting for the promotion of the construction of the feature street, and summing up the annual work of the construction of feature street according to the requirements of the Joint Conference, as well as submitting to the Joint Conference for discussion.

Article 9. Each of the administrative departments for the construction of feature streets will be affiliated with an office, with the director of the office of the administrative department assumed by the chairman or general manager of the relevant major enterprises for the construction and management work. The chief duty of the office includes the development, construction and management of the feature street, in terms of its early planning, mid-term construction, and late investment procurement as well as its daily management, under the instruction of the administrative department, with the leadership of the Joint Conference. They mainly include:

(1). Responsibility for the detailed planning for the development of the feature street. Before the office submits the planning for the development of the feature street, it is required to consult the opinion of the administrative department. It may enter into the approval procedures only after passing the preliminary examination jointly carried out by the administrative department and relevant planning and approval authorities;

(2). Making Suggestions for the positioning of the function of the feature street. The feature streets, when introducing new enterprises and adjusting the structure of the industry, according to the general requirements of the feature streets, need to undergo the approval procedures of the Administrative Department Office before applying for entering the approval procedures;

(3). Coordination and promotion of the development of the feature street. The office is responsible for the investment procurement of the feature street, selecting the qualified enterprises meeting the positioning function of the feature street according to the requirement of the planning for development and the general industrial condition;

(4). Responsibility for the promotion of environmental construction. The office is required to compile the plan for the development of the image and environment of the feature street and take the responsibility of the environmental construction work of the feature street, according to the requirements for approval in accordance with the overall requirement of the function positioning of the feature street;

(5). Responsibility for the daily management of the feature street. The office will launch activities including the “regulated services” and the “integrity services”, strengthen internal management of the feature street, regulate the business conduct of enterprises in compliance with relevant rules, establish a preferable general image of the feature street as well as promote the continuous and steady growth of the economic and social benefit of the feature street;

(6). Responsibility for the formulation and implementation of the annual work plan. Report the annual work plan of the feature street to the administrative department according to the investigation and research result, as well as promotion and implementation of the annual plan;

(7). Responsibility for the organization of the cashing declaration for preferential policies of the feature street;

(8). Responsibility for the coordination of the relevant work in the "New Economic Organization and New Social Organization" of the feature street according to the requirements of relevant district departments;

(9). Responsibility for the website maintenance work including the information collection, data uploading, functions management on the information platform of the “On-line Feature Streets” for the feature street.

Article 10. All of the membership units are required to strengthen coordination among each other on the basis of fulfillment of their own duties by providing policy support, supporting measures and comprehensive services, in a bid to promote the construction and management of the feature streets.

Chapter 3 Conference System

Article 11. The Joint Conference will be held in either the form of a plenary meeting or that of the special meeting.

Article 12. The plenary meeting will be presided either by the Chief Caller of the Joint Conference or the Assistant caller entrusted by the Chief Caller and attended by all the members and chief administrators of the administrative departments. The main issues to be discussed on the plenary meeting include the development planning, crucial decisions, significant events and funds deployment for the construction and management of the feature streets. Meeting minutes on issues including the opinions, resolutions and decisions are required to be kept for the plenary meeting and sent to all the attendees at the plenary meeting after being approved by the Chief Caller of the plenary meeting.

Article 13. The special meeting will be presided by the Director of the Office of the Joint Meeting and attended by some members and the heads of the administrative department offices while being heard by some non-voting participants. The main issues to be discussed on the special meeting include the research and implementation of the resolutions of the plenary meeting as well as coordinating, dealing with and promoting the specific issues and relevant work in the construction of feature streets.

Article 14. The Joint Meeting Office should support the activities including the inspection and learning of the construction management experiences of feature streets and sub-roads from other districts, counties as well as cities in other provinces, with an aim to further enhance the management level of Jing' an District. Chapter 4 Capital Management

Article 15. The construction and management fund of the feature street will be mainly applied to the cases including the construction of the infrastructure of the special streets, daily business management, milieu building, brand image promotion and industry subsidy, with an aim to guide and support the construction and development of the feature streets.

Article 16. The construction and management fund mainly comes from the major enterprises in the construction and management of the feature streets, the district-level fiscal subsidy as well as subsidy issued according to relevant policies of the municipality or district level. The fund line depends on the annual arrangement of projects and the real condition.

Article 17. The construction and management fund may be applied in the following cases:

(1). Construction of the infrastructure It may subsidize the basic infrastructure construction projects including the public infrastructure construction, street illumination devices, street forestation projects, comprehensive renovation of the external facades of buildings as well as maintenance of infrastructure and equipment.

(2). Management of Daily Business It may subsidize the projects of daily business including the daily operational expenditure, staff training, road maintenance, publicity and promotion.

(3). Milieu Building It may subsidize the milieu building projects including the symbols and Slogans as well as the street decorative furnishings for the building of environment and business atmosphere.

(4). Promotion of Brand Image It may subsidize the projects for the promotion of brand image including the themed activities, brand promotion as well as media publicity for feature streets.

(5). Subsidy for Industry Development It may subsidize the industry expenditure in terms including the settlement of specialized enterprises and industrial cultivation development.

(6). Others It may subsidize construction expenditure for significant events approved by the Joint Conference.

Article 18. All the administrative departments are required to submit application for project construction according the overall planning and the working plan of the next year to relevant functional departments, into which the projects name, construction goal, construction contents, projects effects and time schedule should be included.

Article 19. The Office of Joint Conference sorts out and sums up the projects according to the type of the projects applied for by all the administrative departments. All the relevant competent departments are responsible for examination and verification of application projects in terms of basis for project approval, objectives and requirements, feasibility and budget resources and other aspects.

1. As for the projects related to physical infrastructure construction as well as lighting, greening, city appearance and landscapes, the District Municipal Supporting Bureau, the District Greening and City Appearance Bureau and other competent departments are responsible for the project approval and funding application;

2. As for the projects related to daily business management, the Office of Joint Conference together with the District Finance Bureau, the District Audit Bureau and other relevant departments are responsible for the project examination and approval, and the Office of Joint Conference is responsible for funding application;

3. As for the projects related to the building of ambience and the promotion of brand images, the responsible enterprises for construction and management of feature streets take charge of project approval and fund raising according to internal management systems;

4. As for the projects supported by service-guiding funds, technological innovation funds and industry supporting funds, the District Commission of Development and Reform, the District Science and Technology Commission, the District Investment Office and other relevant competent departments are responsible to give guidance for the Offices of Administrative Departments for Construction and Management of Feature Streets for project approval according to the administrative measures for relevant policies.

Article 20. The Office of Joint Conference sums up the examination results of application projects from all the Administrative Departments for Construction and Management of Feature Streets, and reports to the Joint Conference for discussion. Upon discussion and approval, relevant member units and district competent departments will issue the funds and include the appropriation budgets for construction and management projects in the scope of annual budget in the next year in accordance with channels of funding sources as well as relevant regulations and procedures.

Article 21. The budget for construction and management projects is in the charge of relevant responsible construction units for use and management.

1. The budget for the projects related to physical infrastructure construction in feature streets is appropriated from the district financial subsidies to the district municipal supporting bureau and other relevant competent departments which are responsible to manage construction of projects and use of funds;

2. The budget for the projects related to lighting, greening, city appearance and landscapes in feature streets is appropriated from the district financial subsidies to the district greening and city appearance bureau and other relevant competent departments which are responsible to manage construction of projects and use of funds;

3. The budget for the projects related to daily business management in feature streets is appropriated from the district financial subsidies to the General Office of the District People's Government (the Office of Joint Conference) according to the standards for one-time fixed-amount subsidy each year for each feature street (In 2011, each feature street was given the onetime subsidies with the amount of RMB0.5 million or RMB0.6 million according to different processes in construction and development; From 2012 to 2014, each feature street is given the one-time subsidy of RMB0.5 million for three years in a row). The Administrative Departments for Construction and Management of Feature Streets are authorized to take charge of use and management of the budget;

4. The budget for the projects related to the building of ambience and the promotion of brand images is in the charge of the Administrative Departments for Construction and Management of Feature Streets for use and management after being raised by responsible enterprises for construction and management of feature streets themselves;

5. The budget for approval of the projects supported by service-guiding funds, technological innovation funds and industry supporting funds is used in accordance with the administrative provisions for policy funds.

Chapter 5 Daily Management

Article 22. No unit or individual shall remove or change public facilities in feature streets at will. Those that need to remove or change the facilities shall ask for instructions from the Administrative Department for Construction and Management of Feature Streets and handle relevant approval procedures at relevant authorities. As for the units or individuals that remove or change the facilities without permission, the Administrative Department for Construction and Management of Feature Streets shall dissuade or stop them and notify relevant departments for punishment. The units or individuals that cause losses shall assume relevant liabilities.

Article 23. All the outdoor activities on the feature streets are required to undergo procedures for approval by relevant departments. Relevant departments should actively conduct communication with the Administrative Department for Construction and Management of Feature Streets, who will later give written reply to the relevant departments according to the development plan of the feature street and the detailed implementation rules of relevant management measures. These activities include:

(1). Activities including exhibitions, consultations, performances and sports;

(2). Public-oriented activities and commercial promotion activities;

(3). Other cultural, tourist-oriented and mass activities.

If unapproved by relevant authorities, all the aforesaid activities should be persuaded against or prohibited by the Administrative Department for Construction and Management of Feature Streets and reported to the relevant departments for further measures to be taken. The parties concerned in the aforesaid activities should be responsible for any damage caused thereof.

Article 24. The following activities on the feature streets should meet requirements for planning as well as undergo approval procedures at relevant departments according to relevant regulations. Relevant departments should actively conduct communication with the Administrative Department for Construction and Management of Feature Streets, which will later give written reply to the relevant departments according to the development plan of the feature street and the detailed implementation rules of relevant management measures. These activities include:

(1). Establishment, extension and renovation of buildings, fa?ade decoration of buildings along the street (including decoration and wall-drilling of the streetside stores);

(2). Installation of Landscape Lighting Equipment;

(3). Street digging and occupancy;

(4). Installation of Outdoor Advertisements, plaques or columns for publicity of public-oriented issues, publicity slogans, colored flags decoration, decorative lighting as well as other decorative articles;

(5). Installation of outdoor trade name plaques;

(6). Other activities that may temper with the image of the feature streets.

If unapproved by relevant authorities, all the aforesaid activities should be persuaded against or prohibited by the Administrative Department for Construction and Management of Feature Streets and reported to the relevant departments for further measures to be taken. The parties concerned in the aforesaid activities should be responsible for any damage caused thereof.

Article 25. During the approval procedures, relevant functional departments should actively communicate with the Administrative Department for Construction and Management of Feature Streets, especially when spotting activities that could have great impacts on the development of the feature streets, or hamper the implementation of the development plan of the feature streets. The Administrative Department for Construction and Management of Feature Streets will later give written reply to the relevant departments according to the development plan of the feature street and the detailed implementation rules of relevant management measures.

Chapter 6 Attachments

Article 26. The Administrative Departments for Construction and Management of Feature Streets are required to formulate the detailed implementation rules for management on the basis of these measures. The detailed implementation rules formulated should be approved by and filed at the Office of the Joint Conference.

Article 27. These measures will be enacted after 30 days from the releasing day.
