Article 1 Purposes and Basis
The purposes of the Measures are to implement Shanghai Municipality's strategies of innovation-driven transformed development and accelerating building Shanghai into an innovative city during the twelfth five-year plan, to foster a favorable technological innovation atmosphere by continuously strengthening regional technological innovation capacities and enterprises' vigorous independent innovation, and to ensure the standardized and efficient usage of the fiscal funds.
The Measures are formulated pursuant to the Law of the People's Republic of China on Science and Technology Progress, Regulations of Shanghai Municipality on Science and Technology Progress, as well as Platform for Action of Jing'an District on Strengthening Technological Innovation Capabilities (2011-2015) and in light of the district's realities.
Article 2 Principles
Science and technological innovation shall stick to the administrative principles of “funds being overall-planned by the district and managed by departments, projects being set up separately and approved centrally with procedures standardized and supervision strengthened”.
Technological Innovation Fund (hereinafter referred to as “the Fund”) and projects are managed in the principle of “the one who apply should be responsible for the administration”. The responsibility of fund utilization should be defined and clarified, with management of fund subject to the management of functional department being the responsibility of correspondent department, so as to ensure standardized and reasonable management and effective utilization.
Article 3 Scope of Application
The Fund is applicable to enterprises and public institutions registered with the District's Commercial and Business Administrations and Tax Bureau as a legal person, district offices, groups, other organizations and nature persons living or working in the District.
Article 4 Source of Fund
The Fund is earmarked by Jing'an District People's Government to support and promote technological innovation in all respects in the district, subject to district level procedures of budgeting, utilization and administration.
Article 5 Uses of Fund
With the concepts of “science and technology improves business values, quality of life and city eco-environment”, the Fund is used to: a) promote economic transformation by focusing on fostering economic growth areas and collective innovation; b) support social development by enhancing livelihood focuses and people's all-round development; c) optimize soft innovation environment by bolstering soft development strengths and the government's governance and service capabilities.
Fiscal support shall focus on the five respects below:
1. Improving enterprises' independent innovation capabilities: national and Shanghai municipality's science and technology innovation polices shall be implemented and R&D, commercialization and industrialization of hi-tech achievements to foster technologically innovative mainstay enterprises with core competitiveness; SMEs shall be encouraged to reinforce technological innovation, investment in scientific researches and brand-building and, listing and IPR protection be supported to promote companies' transformed development;
2. Fostering cultural, creative and other emerging industries: focusing on fashion design, culture and media, and play and entertainment, enhancing functional building of creative incubators and innovative industrial parks, and strengthening the development of creative and innovative industries;
3. Promoting the application of scientific and technological innovative achievements: encouraging the trial and application of new models, products, achievements of scientific and technological innovation in the District in the form of projects to support the District's all-round development in all respects of social building;
4. Building an “intelligent Jing'an” comprehensively integrating information technology and district development: enhancing investment in information infrastructure to build an intelligent district that aims at more efficient e-governance, more convenient public service, safer district management and better business environment;
5. Optimizing technological innovation environment: focusing on pooling together resources and talents, building district technological innovation think tanks and various public service platforms, strengthening forward-looking researches and scientific decision-making, enhancing popularization of scientific knowledge, improving citizens' scientific awareness, improving capabilities of managing technological innovation and reinforcing the building of serving government.
Article 6 Fiscal Support Methods
The Fund is mainly utilized in the form of project subsidy, discount loans, award and allowance, purchasing services, etc. Technology venture capital fund will be established wherever appropriate.
Article 7 Administration Structure
Science and Technology Progress and Independent Innovation Leading Group of Jing'an District (hereinafter referred to as “the Leading Group”) shall be responsible for the arrangement, planning, decision-making, coordination and promotion of the District's technological innovation, and the administration and supervision of the Fund's overall utilization.
The office subordinating to the Leading Group (hereinafter referred to as “the Office”, with the routine work undertaken by the District's Science and Technology Commission) shall be responsible for compiling the District's annual technological innovation plans and publishing annual technological innovation guidelines; consolidating projects applied for overall budgeting and submitting that to the Leading Team for review and approval; summarizing annual technological innovation reviews and organizing third party agencies to assess technological innovation projects wherever appropriate.
As the applicants of technological innovation projects, relevant governmental departments shall be responsible for annual technological innovation plans and projects and budgets application; the implementation and management of technological innovation projects and the standardized utilization of funds, as well as the performance assessment upon the completion of the projects. They shall also put forward measures for the administration of technological innovation projects and funds respectively in light of their functions and the regulations of fiscal funds.
Article 8 Project Application
In light of their next year's planning and actual needs, all departments shall submit annual technological innovation plans to the Office at the third quarter each year, and submit technological innovation projects, budgets and feasibility reports upon preliminary approval.
Article 9 Project Appraisal
The Office shall organize the District Development and Reform Commission (DRC), Science and Technology Commission (STC) and Finance Bureau to review the applying projects and engage experts whenever necessary.
The District DRC shall be responsible for reviewing the legitimacy and necessity of setting up the projects, i.e., if the functional positioning of the projects is in compliance with the needs for the District's economic and social development and the government's key investment areas.
The District STC shall be responsible for reviewing the innovativeness of the projects. It shall engage experts or consign third party assessment agencies to review the functional positioning, technological sophistication and innovativeness of projects involving significant budgets.
The District Finance Bureau shall be responsible for reviewing the budgets of applying projects.
The Office shall consolidate and arrange the project in accordance with the District's key technological innovation areas and the opinions of abovementioned units or experts, so as to compile the annual plan of technological innovation projects and budgets to be reviewed by the Leading Group.
Article 10 Approval Procedures
Annual technological innovation projects and budgets approved by the Leading Group shall be submitted by the Office for the approval of the District government's standing meeting, which shall be the basis for project initiation and fund utilization. Projects fall into the categories of “major decision-making, major personnel appointment, major investment and utilization of large amount of fund” shall be submitted to the District's standing party committee for approval.
Article 11 Project Final Approval
Once their annual technological innovation projects and budgets passed at the District government's standing meeting, the applying departments shall submit Project Application, Project Feasibility Report and Project Budget Breakdown for the joint approval of the District DRC, STC and Finance Bureau.
The District DRC shall finalize the approval of technological innovation projects in accordance with relevant regulations and administrate the projects as part of the District government's investment program.
The District Finance Bureau shall review and approve the budgets, which shall be managed as part of the applying department's budget and shall remain unchanged without authorization.
Article 12 Project Management
Applying departments shall be responsible for the overall management of project implementation and budge utilization.
Upon the completion of the projects, the applying departments shall check, accept and summarize the implementation of the project, the utilization of the fund and the assessment of the performance, and submit relevant files to the Office for documentation.
Article 13 Procurement and Bidding
Applying departments shall abide by Law of the People's Republic of china on Government Procurement and Law of the People's Republic of china on Tenders and Bids when handling government procurement and project tendering and bidding of the annual technological innovation projects passed at the District government's standing meeting.
Article 14 Fund Appropriation
The District Finance Bureau shall be responsible for the appropriation of fund. The Fund shall be directly appropriated to the applying departments on the strength of documents issued by the District government in accordance with legitimate procedures.
Construction funds under project management shall be appropriated by installment, with 30% being appropriated upon the check and acceptance, final settlement of accounts, report and documentation of the completed project.
Article 15 Fund Utilization
The Fund shall be not utilized other than on the approved projects. If projects fail to be conducted in accordance with the plan, schedule and purpose due to objective causes, the applying departments shall apply for alteration and implement accordingly upon consent of relevant authorities and approval of the Office. Alteration of major projects shall be reviewed and approved by the Leading Group.
Applying departments that swindle, misappropriate the funds or terminate projects at will (rather than due to force majeure) shall be deprived of the earmarked funds and the eligibility of applying in three years.
Article 16 Fund Supervision
The Office shall organize effectiveness assessment of the annual technological innovation fund and performance assessment of major projects, and entrust third parties for panel assessment.
The District Finance Bureau shall be responsible for the budget management and the supervision and inspection of the utilization of the Fund.
The District Audit Bureau shall be responsible for follow-up auditing, audit of final accounts and performance auditing of major projects, and effectiveness assessment of annual technological innovation fund and projects with over-two-million-yuan budget.
The District Supervision Bureau shall conduct administrative effectiveness supervision and inspection of the implementation of relevant projects.
Article 17 Effective Date
The Measures shall come into force 30 days after its promulgation. Measures of Jing'an District for the Administration of Funds for Technological Innovation (Jing Fu Fa  No. 20) promulgated by the District government on May 18, 2007 shall cease to be in effect as of the same date.
