Several Opinions of Jing'an District on Improving, Stabilizing and Expanding Employment Policies

So far, the negative impact of global financial  crisis is still influencing the labor market. The structural contradiction of  employment is still outstanding. Jing'an District will further implement the  “Employment Promotion Law of the People's Republic of China”, effectively  implement the municipal and district government's targets and requirements on  promoting employment, and implement more active employment policies. Based on  the current situations, the “Several Opinions of Jing'an District on Improving,  Stabilizing and Expanding Employment Policies” has been drafted to stabilize and  expand the existing employment market. The specific contents of this document  are shown as follows:

I. For people with job hunting difficulties  recognized by the municipal government and whose household registrations are in  Jing'an Distric

TPeople with job hunting difficulties refer to  (according to the unified standards of Shanghai) those laid-off workers,  laid-off workers who have signed coinsurance agreement with their employers,  surplus laborers in rural areas who have working capacity and are willing to  find jobs, but are unable to find jobs on the labor market due to their own  unfavorable employment conditions, and those who have been unemployed for more  than 6 months. Specifically, people with job hunting difficulties include: 1)  laid-off workers and laid-off workers who have signed coinsurance agreement with  their employers (Men above 45 years old and women above 40 years old); 2)  families in cities and townships in which no family members were employed by  others; 3) people in rural areas with low wages; 4) people accepting minimum  living standard subsidies for more than 3 months; 5) people with moderate  disability or losing a part of their working capacity; 6) people whose land was  acquired by the government, having accepted living subsidies from the government  for a certain period, but still can not find jobs; 7) other people with job  hunting difficulties, such as emancipists;

Article 1 Public Welfare Posts in Communities.  Workers who have found jobs via public welfare service agencies in communities  will receive social insurance allowance of RMB180 per month. Workers who have  found jobs via “Employment Projects in Jing'an District” and signed labor  contracts or agreements for more than (including) 1 year will receive post  allowance, social insurance allowance, seasonal allowance and Jing'an residents'  subsidies based on relevant standards.

Article 2 “Employment for Thousands of People”  Project. The project shall be implemented in accordance with the “Notice on  Several Opinions to Implement the ‘Employment for Thousands of People' Project”  (Hu Fu Ban [2004] No. 3), and other documents of Shanghai Municipal Government,  other relevant committees, offices and bureaus. Workers with household  registration in Jing'an District will receive post allowance of RMB100 per  month. Workers on posts with hard working conditions will receive special  allowance of RMB100 per month.

Article 3 Various Employers. Enterprises, public  institutions, social groups and private non-enterprises (except labor dispatch  companies) in Shanghai will receive subsidies from the municipal government in  accordance with the “Several Opinions on Strengthening Employment Assistance and  Stabilizing Employment Situation in 2009” (Hu Ren She Jiu [2009] No. 13).  Laid-off workers will receive an annual subsidy of RMB10,000. Laid-off workers  signing coinsurance agreement will receive an annual subsidy of RMB5,000. The  period of subsidy will be 2 years.

Article 4 Informal Employment and Labor  Organizations for Profit. Informal labor organizations for profit will receive  post allowance of RMB200 on a monthly basis for each employee, provided that the  employees have signed labor agreements of more than (including) 1 year with  their employers and have fulfilled their employment registration and filing  formalities. The amount of social insurance subsidy being contributed by the  employer shall be calculated based on the 48% of the minimum monthly salary of  employees in Shanghai of that year.

Article 5 New Entrepreneurship Organizations.  Employees in newly-established small businesses, private non-enterprise units  and privately-owned businesses will receive subsidies by the government,  provided that they have signed labor contracts with their employers for more  than (including) 1 year and have contributed social insurance fees. The amount  of social insurance subsidy being contributed by the employer shall be  calculated based on the 60% of the average salary of employees in Shanghai of  that year. The period of subsidy shall be 18 months.

II. For special people whose household  registrations are in Jing'an District, but can not be recognized as people with  job hunting difficulties

Article 6 “Elderly People with special job  hunting difficulties” refer to laid-off workers and workers with coinsurance  agreement (Men above 55 years old and women above 45 years old) in Jing'an  District who are willing to seek employment, but have difficulties in making a  living and have not been unemployed for consecutively 6 months. These people are  entitled to receive various subsidies when they have found jobs in accordance  with the standards for “people with job hunting difficulties.”

III. For laid-off young people who are actively  seeking employmen

TArticle 7 Professional Skills Training. Young  people whose household registrations are in Jing'an District and have attended  government subsidy training programs in Jing'an District will receive living  expense subsidies on a monthly basis based on the hours of class they have  attended after they have finished their examinations. The standard of subsidy  shall be 60% of the minimum monthly salary of employees in Shanghai of that  year. Young people who have passed the examinations will receive a subsidy of  RMB400.

Article 8 Internship. Apart from living expense  subsidy and instructor's subsidy on the municipal level, each youth with  household registration in Jing'an District will be given another RMB500 each  month as a living expense subsidy during the period of internship. RMB50 will be  given to instructors in internship bases in each month as subsidies. A reward of  RMB400 to RMB800 will be given to each youth with household registration in  Jing'an District who has found job (except jobs in informal labor organizations)  within 6 months after the end of internship. A reward of RMB200 will be given to  youths in internship bases whose household registrations are in other  districts.

Article 9 The “Training + Internship +  Employment” Mechanism. Training agencies, internship bases and enterprises  participating in the operation of mechanism will be given special subsidies.  Subsidies will be given to training classes losing money after the end of  training sessions. In each class, the number of trainees obtaining subsidies  shall be no more than 5. RMB500 will be given as rewards to each young person in  internship bases who has household registration in Jing'an District and has  found jobs within 6 months after the end of internship. Subsidies will be given  to enterprises that have signed labor contracts with young employees for more  than (including) 1 year and have contributed social insurance fee for them. The  amount of social insurance subsidy being contributed by the employer shall be  calculated based on the 60% of the average salary of employees in Shanghai of  that year. The period of subsidy shall be 1 year.

Article 10 The “Apprenticeship Plan”. An  “Apprenticeship Plan”, which will last for less than 6 months, will be  implemented for young people who have household registrations in Jing'an  District and are willing to find jobs. Living expense subsidies will be given on  a monthly basis to young people participating in this plan. The standard of  subsidy shall be 60% of the minimum monthly salary of employees in Shanghai of  that year. RMB300 will be given to instructors of interns as subsidy on a  monthly basis. RMB500 will be given respectively to young people who have found  jobs and their instructors as rewards.

Article 11 Employment Base for Young People in  Jing'an District. Enterprises with registered capital above RMB1 million are  encouraged to apply for “Employment Base for Young People in Jing'an District”.  These enterprises shall be willing to undertake social responsibility and  provide jobs to young people. Subsidies will be given to the “Employment Base”,  provided that it has found jobs for laid-off young people being recommended by  the Human Resource and Social Security Bureau of Jing'an District, signed labor  contracts with them for more than (including) 1 year and contributed social  insurance fee for them. The amount of social insurance subsidy being contributed  by the employer shall be calculated based on the 60% of the average salary of  employees in Shanghai of that year. The period of subsidy shall be 1 year.

Article 12 Employment by Social Organizations.  Elderly and disabled assistance organizations, public welfare organizations that  have registered in the district bureau of societies, personal care and service  centers in various sub-districts and communities shall be encouraged to recruit  young people with household registration in Jing'an District. Subsidies will be  given to these organizations, provided that they have signed labor contracts  with young people for more than (including) 1 year and contributed social  insurance fee for them. RMB200 will be given to each young person on a monthly  basis as post allowance. The amount of social insurance subsidy being  contributed by the employer shall be calculated based on the 48% of the average  salary of employees in Shanghai of that year. The period of subsidy shall be 2  years.

Article 13 Purchase the Achievements of  Intermediary Agencies. Social intermediary agencies, such as head-hunting  companies and employment agencies, shall be encouraged to participate in  employment service. RMB500 will be paid to intermediary agencies to purchase  their service achievements for each laid-off worker. Such laid-off worker shall  have a household registration in Jing'an District, find a job (except jobs in  informal labor organizations), sign a labor contract with his employer for more  than (including) 1 year, and contribute social insurance fee according to  law.

IV. For young people who are willing to set up  their own business

Article 14 Entrepreneurship Internship. Young  people who are willing to set up their own business are entitled to participate  in internship programs in various entrepreneurship internship bases in Jing'an  District. Living expense subsidies and instruction fee subsidies will be given  to these young people in accordance with relevant policies. An instruction fee  subsidy of RMB1,000 will be given to each young person in the internship base,  provided that their household registration is in Jing'an District. A living  expense subsidy of RMB500 will be given to each intern on a monthly basis.  Interns who have successfully set up their own business in Jing'an District  within 6 months will be given a reward of RMB8,000 per person.

Article 15 Entrepreneurship Pre-incubation in  Industrial Parks. Industrial parks in Jing'an District are encouraged to  establish “Entrepreneurship Training Base for College Students” by cooperating  with various universities, and provide business venues, without rents being  collected, for college students who are willing to set up their own business.  Subsidies will be given to experts and volunteers providing “pre-incubation”  guidance service to students. The amount of subsidy shall be based on the rate  of commercial rents of the industrial parks.

Article 16 Microcredit Guarantee. A maximum  microcredit guarantee of RMB100,000 will be given to young people who have  entrepreneurship projects and are willing to establish small businesses, private  non-enterprise units and privately-owned businesses in Jing'an District. The  borrowers who have repaid capital with interest on time will be given subsidies  on interest payment based on the actual interest they have paid to banks.

Article 17 Provide Information on  Entrepreneurship Projects. More efforts should be made to explore and purchase  entrepreneurship projects being provided by professional service agencies. These  projects shall conform to the social and economic development orientation of  Jing'an District, and shall be suitable for the characteristics of young people.  Government authorities should provide the latest business information to  entrepreneurs and potential entrepreneurs free of charge.

Article 18 Agency Services for Going through  Relevant Formalities. Authorized service agencies will go through relevant  formalities for young entrepreneurs free of charge. RMB2,000 will be paid to  each successfully registered enterprise to purchase its service  achievements.

V. For entrepreneurs who have set up their own  business in the past 3 years

Article 19 Subsidy for Organization Costs.  RMB10,000 will be given to entrepreneurs as subsidy for organization costs,  provided that these entrepreneurs have established small businesses, private  non-enterprise units and privately-owned businesses in Jing'an District,  finished new employee enrollment procedures, and contributed social insurance  fee for employees for more than (including) 6 months.

Article 20 Financial Aid for Initial Capital.  RMB10,000 will be given to entrepreneurs in Jing'an District as initial capital,  provided that these entrepreneurs have established small businesses, private  non-enterprise units and privately-owned businesses that conform to the pillar  industry and developing orientation of Jing'an District, such as serving the  Expo 2010, advocating the concept of environmental protection and low carbon,  and encouraging the development of community service and social organizations.  Meanwhile, the entrepreneurship projects of entrepreneurs shall be verified and  recognized by experts in relevant fields.

Article 21 Loan Guarantee for Starting Business  and Subsidies on Interest Payment. Small businesses and private non-enterprise  units at the initial stage of business operation could apply for a loan  guarantee on the maximum of RMB1 million. It is unnecessary for individuals  whose personal loans are less than 100,000 RMB to provide personal guarantee.  Enterprise will be given an annual subsidy on interest payment by municipal and  district government. The amount of subsidy will be no more than RMB2,000 for  each laid-off worker that the enterprise has recruited. Subsidy on interest  payment on district level will be granted on an equal basis based on the  municipal-level subsidy on interest payment and will be limited by the actual  interest being paid to banks. Loan guarantee and subsidies on interest payment  will be given to students from other regions in China who graduated from  universities in Shanghai, provided that they have established their own business  within 2 years after graduation. Subsidies on interest payment will be given to  young entrepreneurs in Jing'an District in full amount based on the actual  interest they have paid to banks.

Article 22 Support to Sites of Business  Operation. Entrepreneurs who have established small businesses, private  non-enterprise units, privately-owned businesses and informal labor  organizations in industrial parks of Jing'an District will be given an annual  rent subsidy of no more than RMB2,000 per person by the municipal and district  government based on the actual number of laid-off workers the companies have  recruited, provided that the actual business operation sites of companies are  identical with their place of registration. The period of subsidy will be 3  years. Entrepreneurs who have established enterprises (expect informal labor  organizations) outside the industrial parks of Jing'an District will receive  subsidies of the same standards. The period of subsidy will be 18 months. Apart  from the above subsidies, entrepreneurs who have established small businesses,  private non-enterprise units and privately-owned businesses in industrial parks  of Jing'an District will receive an annual rent subsidy of RMB2,000. The period  of subsidy will be 18 months. Rent subsidies and subsidies on interest payment  will be given to young entrepreneurs with household registration of Jing'an  District.

Article 23 Reduce Labor Cost. Entrepreneurs who  have established small businesses, private non-enterprise units and  privately-owned businesses in Jing'an District, employed laid-off workers with  household registration in Jing'an District, signed labor contracts for more than  (including) 1 year with these workers, and contributed social insurance charges  according to law, will be granted with a social insurance subsidy of RMB300 for  each worker in each month. Entrepreneurs who have employed young people with  household registration in Jing'an District will be granted with a social  insurance subsidy of RMB500 for each worker (including the business owner  himself) in each month. Young entrepreneurs who have established informal labor  organizations in Jing'an District and employed young laid-off workers with  household registration in Jing'an District will be granted with a social  insurance subsidy of RMB200 for each worker (including the business owner  himself) in each month.

Article 24 Assistance on Loan Formalities and  Book-keeping. For those professional service agencies that have successfully  assisted young entrepreneurs in applying for business loans free of charge,  RMB1,000 will be paid to these agencies for purchasing their service  achievements. For service agencies providing book keeping service to young  entrepreneurs who graduated from colleges or professional schools in the past 5  years, their service achievements will be purchased at the rate of 80% of the  service charge in the previous 6 months, and at the rate of 50% of the service  charge in the latter 12 months. Other charges shall be undertaken by the  entrepreneurs at their own costs. The period of purchase shall be 18 months.

Article 25 Legal Consulting Service. For social  organizations in Jing'an District providing free legal consulting service to  young entrepreneurs who graduated from colleges or professional schools in the  past 5 years, a certain amount of funds will be granted to purchase the service  achievements of these organizations. The period of purchase shall be 2  years.

VI. For laid-off workers with household  registration in Jing'an District and who have registered to set up their own  business

Article 26 Loan Guarantee for Small Business.  Laid-off workers with household registration in Jing'an District who have  registered to set up their own business are entitled to apply for a loan  guarantee for small business. Workers at the initial stage of entrepreneurship  will be given a guarantee from RMB3,000 to RMB8,000, with a period of guarantee  from 3 to 18 months. Workers whose businesses are under the developing stage  will be given a guarantee from RMB10,000 to RMB30,000, with a period of  guarantee of 3 years. Entrepreneurs who have repaid capital with interest will  be given subsidies on interest payment by both municipal and district government  based on the actual interest they have paid to banks.

Article 27 Rent Subsidy for Sites of Business  Operation. Laid-off workers with household registration in Jing'an District who  have registered to set up their own business and have started business operation  in fixed sites for 1 year are entitled to apply for a rent subsidy. Business  owners (family members who set up an enterprise together shall be regarded as  one unit) will be given an annual subsidy of no more than RMB2,000 by the  municipal and district government based on the actual rent paid by them. The  period of subsidy shall be 3 years.

VII. For new graduates of colleges and  professional schools

Article 28 Internship. College and professional  school graduates with household registration in Jing'an District could apply for  an internship with their employment recommendation forms. Students will be given  subsidies of living expenses and instructor's subsidies in accordance with  relevant policies of Shanghai Municipal Government.

Article 29 Professional Skills Training. For  secondary vocational school graduates with household registration in Jing'an  District who have accepted professional skill training program under the subsidy  contents of the government and have passed relevant examinations, each graduate  will be given a subsidy at the rate of 50% of their training fees in accordance  with the governmental subsidy policies for college graduates.

VIII. For people participating in various  professional skills training

Article 30 Training Programs with Government  Subsidies. According to the “Interim Measures of Shanghai on Subsidies for  Occupational Skills Training Programs”, subsidies will be given to laid-off  workers, laid-off workers who have signed coinsurance agreement with their  employers and in-service staffs at the rate of 100% or 50% of their training  fees on municipal level. These workers shall participate in training programs in  training agencies in Jing'an District and pass relevant examinations (programs  in the subsidized training contents of Shanghai Municipal Government in the same  year).

Article 31 Job-oriented Training for Laid-off  Workers. Training agencies in Jing'an District will be granted with a one-time  subsidy based on the number of re-employed workers who have participated in  job-oriented training. The amount of subsidy will be RMB500 for laid-off workers  whose household registers are in Jing'an District, and RMB200 for workers whose  household registers are in other districts. All laid-off workers who have  accepted the training program, passed relevant examinations, and have found jobs  after being recommended by the training agencies within 6 months, will be  granted with subsidies. Training agencies will be granted with a one-time  subsidy based on the number of re-employed workers. The amount of subsidy will  be  RMB500 for workers whose household registers are in Jing'an District, and  RMB100 for workers whose household registers are in other districts.

Article 32 Intermediate and Advanced Training for  Laid-off Workers and In-service Staffs. All Laid-off workers, laid-off workers  who have signed coinsurance agreement with their employers, and in-service  staffs who have participated in intermediate and advanced training programs in  Jing'an District and have passed relevant examinations, will be granted with  subsidies from the training agencies. A subsidy of RMB100 will be granted to  workers with an intermediate certificate. RMB300 will be granted to workers with  an advanced certificate. RMB400 will be granted to workers with a technician  certificate. RMB500 will be granted to workers with a senior technician  certificate.

Article 33 Vocational Training for Migrant  Workers. Migrant workers will be encouraged to enhance their professional  skills. For migrant workers who have participated in vocational training  programs in Jing'an District and have passed relevant examinations (programs in  the subsidized training contents of Shanghai Municipal Government in the same  year), each worker will be granted with a subsidy of RMB100 by training  agencies.

Article 34 Specialized Training. All A-level  training agencies in Jing'an District and training agencies with brand effect  programs shall be encouraged to expand their scales and enhance their training  standards. For some intermediate and advanced training programs of modern  service industry, IT service industry and creative industry, the training  agencies will be granted with a subsidy of RMB400 for each trainee based on the  number of trainees who have passed examinations.

Article 35 Professional Skills Competition.  Professional skills competitions above intermediate-level will be organized by  the district government. These competitions shall conform to the functional  orientation and industrial development orientation of Jing'an District. All  training agencies will be granted with a subsidy of RMB100 for each trainee,  unrestricted by the subsidy contents of Shanghai Municipal Government. As for  the individual career training programs jointly organized by group companies,  enterprises, public institutions and training agencies in Jing'an District, all  training agencies will be granted with a subsidy of RMB300 for each trainee,  provided that the trainee has passed relevant examinations.

IX. For employees in troubled businesses

Article 36 Assistance after Affirmation. Continue  to implement the “Notice on Matters Related to Relieving Burdens for Troubled  Businesses and Stabilizing Employment in 2009” (Hu Ren She Jiu Fa [2009] No.  16). As for those troubled businesses, enterprises with special difficulties in  the district, which have been acknowledged by the municipal government, both  municipal and district government shall offer assistance to these enterprises  and their employees.

Article 37 Encourage Workers to Accept Job  Transfer Training. As for state-owned enterprises providing job transfer  training to their employees for the reason of adjusting their management  direction and product structure, and enterprises in Jing'an District with more  than 50 employees accepting such training programs, each enterprise will be  granted with a subsidy of RMB200 for each employee, unrestricted by the subsidy  contents of Shanghai Municipal Government.

Article 38 The “Young People” in this document  refer to people under (of) 35 years old. All entrepreneurial supportive policies  and subsidy policies in this document are promulgated for people (organizations)  who have accepted the entrepreneurship guidance service jointly provided by the  Human Resource and Social Security Bureau of Jing'an District and the other  district departments and sub-district offices, and have successfully established  their own business within the jurisdiction of Jing'an District.

Article 39 All funds involved in this document,  except the funds being paid by the Municipal Government (The Municipal  Unemployment Insurance Fund), will be paid by the District Financial Aid  Office's Special Funds for Employment Promotion. Unless otherwise stated, all  people involved in this document refer to Shanghai residence holders.

Article 40 The Human Resource and Social Security  Bureau of Jing'an District are responsible for the interpretation of this  document. The document shall be implemented in accordance with relevant rules  and shall go into effect since January 1, 2010. The term of validity of this  document shall be 1 year. If new rules were promulgated by Shanghai Municipal  Government or Jing'an District Government, these opinions shall be implemented  in accordance with the new rules.
