Trademark and Solution of Tortious Case

  In 2005, 29,105 trademark registration applications were received inShanghai, of which 11,977 applications were approved. By the end of 2005, in the city, there were an accumulative total of 99,863 valid registered trademarks, 318 well-known trademarks ofShanghaiand 43 famous trademarks of China, continuing ranking among the first in the country.
  In 2005, the industrial and commercial authorities of Shanghai Municipality mobilized law-enforcement personnel totaling over 30,000 person-times, inspected over 100,000 business shops of different categories, inspected 8,000 (times) commodity trade markets of different categories, investigated and dealt with 1,227 illegal trademark cases, of which there were 1,108 trademark privilege infringement cases, 6.61 tons of infringement commodities were confiscated or destroyed, 1.6176 min. infringement trademark labels were confiscated or removed.
  The Industrial and commercial authorities of Shanghai Municipality has put forward four key measures for cracking down on counterfeit trademarks and trademark privilege infringement: the first is to strengthen key trademark protection; the second is to crack down more severely on counterfeit trademarks of key commodities such as food, pharmaceutics, etc.; the third is to strengthen the rectification and administration of key markets and areas; and the fourth is to strengthen the supervision and administration of key links.
  In 2005, the municipal industrial and commercial authorities, on the basis of work carried out to ban the sale of 40 commodities bearing world famous trademarks like "LV"in the garment, ornament and small commodity markets in the whole city, adopted measures to further intensify and consolidate their work related to "Sale Ban in the Market The industrial and commercial authorities promulgated《Sale Ban Notice》in English, issued to travel agencies《Notice on Organizing Tourists in Cooperating in the Implementation of the Ban on Counterfeit Commodities Involved in Trademark Privilege Infringement in their Purchasing Activities》; urged market managers to honor their commitments related to "Warning after the First Violation, Expelling after the Second Violation Besides, the Industrial and Commercial Administrative Sub-Bureaus of the Districts concerned have joined hands in cracking down on illegal infringement activities in the neighboring areas of Xiangyang Road Market. In 2005, over 3000 copies of《Sale Ban Notice》in both Chinese and English were issued and posted in the whole city, over 1000 copies of《Proposal》banning the sale of counterfeit commodities posted, over 3000 copies of《Notice on Organizing Tourists in Cooperating in the Implementation of the Ban on Counterfeit Commodities Involved in Trademark Privilege Infringement in their Purchasing Activities》issued to various travel agencies, and over 10 booths selling counterfeit commodities expelled. With the efforts from various parties, Xiangyang Garment, Ornament and Gift Market was formally closed on June 30, 2006.
  In 2005, the industrial and commercial authorities in the whole city continued to intensify the protection of well-known foreign trademarks, and investigated and handled 652 cases involving foreign trademark privilege infringement, accounting for 58.8% of the total number of the cases involving trademark privilege infringement. Over 80 well-known foreign trademarks protected includeLV, PRADA, SONY, BURBURY, NIKE, etc.. For example, the Baoshan Industrial and Commercial Administrative Sub-Bureau seized in a warehouse nearly 300,000 pairs of jeans bearing suspected counterfeit "A&F"trademark of USA, and the Changning Industrial and Commercial Administrative Sub-Bureau investigated a case of car fittings bearing suspected counterfeit "Mazda trademark of Japan and distributed by a trade company, and seized 1,137 pieces of car fittings involved in the trademark privilege infringement. Besides, the industrial and commercial authorities in the whole city investigated in time a number of serious and important cases of production and sale of commodities infringing trademark privilege. In 2005, 35 cases of trademark infringement and counterfeit trademarks, each involving a value of over 100,000 RMB yuan, were investigated and handled. At the same time, the industrial and commercial authorities of the city actively made a good job of linking administrative punishment with investigating and affixing criminal responsibilities by timely hand-over of cases of suspected trademark privilege infringement and counterfeit trademarks discovered to public security organs. In 2005, the industrial and commercial authorities of the city handed over 11 cases of suspected trademark crimes, involving 13 people.
