Article 1(Purposes and Basis)
With a view to guaranteeing the freedom of religious belief for foreigners in Shanghai, safe guarding the public interests of the society, these Procedures are formulated in accordance with the “Provisions on the Administration of Religious Activities Held by Foreigners within the Territory of the People’s Republic of China” and the “Detailed Implementation Rules for the Provisions on the Administration of Religious Activities Held by Foreigners within the Territory of the People’s Republic of China” as well as other relevant laws, rules and regulations, and in light of the actual circumstances of this Municipality.
Article 2(Administrative Departments)
The religious affairs department of the Shanghai Municipal People’s Government (hereinafter referred to as MRAD)is the competent department in charge of the temporary sites for religious activities held collectively by foreigners inShanghai.
The religious affairs departments of the district/county people’s governments (hereinafter referred to as district/county RAD) shall be in charge of the supervision and inspection of the temporary sites for religious activities held collectively by foreigners inShanghaiin their respective jurisdictions.
Article 3(Provisions on Places for Collective Religious Activities)
Foreigners’ collective religious activities in Shanghai shall be held in temples, Taoist temples, mosques, or churches(hereinafter referred to as TMC)approved by the district/county RAD and registered in accordance With laws; When necessary, they may be held at the temporary sites designated by the MRAD. Generally, the temporary sites shall be arranged at public places that meet the requirements of fire prevention, public security and sanitation.
Foreigners who conduct collective religious activities inShanghaishall abide by Chinese laws, rules and relevant provisions.
While foreigners hold collective religious activities at TMC or the temporary sites inShanghai, the district/county RAD may conduct supervision and inspection over the condition of observing Chinese laws, rules and relevant provisions.
Article 4(Application for Temporary Sites)
In case foreigners need to hold collective religious activities at the temporary sites other than TMC inShanghai, congregants who organize foreigners’ collective religious activities (hereinafter referred to as congregants)shall apply to the RAD of the district/county where the sites for religious activities are set up and provide the following materials as well:
1．Reasons for applying for the temporary site;
2．The specific address of the site;
3.Congregant’s relevant information, such as name, nationality, occupation, age, status assumed in China ,service place in this Municipality, and residence certificate, etc. ;
4．The number and nationality of the people participating in the collective religious activity;
5．The time, scale, way of activity and source of fund for the collective religious activity;
6．Systems related to self-management; and
7．Materials concerning the sutra, doctrines and canons and history of the religion.
Article 5(Designation of Temporary Sites)
The district/county RAD shall, within 5 working days from the date of receipt of the application documents, solicit opinions from related sub-district offices or town/township people’s governments as well as the departments of public security, public health, etc. on relevant circumstances of the site applied for, etc., and then report the case to the MRAD for examination and verification.
The MRAD shall, within 15 working days from the date of the receipt of documents submitted by the district/county RAD, conduct the examination and verification of such documents and also make decision on the designation of the temporary site after soliciting opinions from relevant religious organizations of municipal level. In case of approval of the designation of the temporary site, a written decision shall be made to approve the designation. In case of disapproval of the designation of the temporary site, a written decision shall be made to disapprove the designation and state the reasons therefore.
Article 6(Validity Period of Temporary Sites)
The longest validity period of temporary sites shall be one year counting from the date of designation.
In case a temporary site is still needed for continuing activities beyond its validity, the congregant shall apply to the MRAD for extension 30 days before the expiration of the validity. The MRAD shall make decision of approval or disapproval of the extension on the basis of the application of the congregants before the expiration of the validity of the temporary site.
In case of alteration of the congregant, time, and mode of collective religious activities, the congregant shall go through the alteration formalities with the MRAD.
Article 8(Obligations of the Congregant)
The congregant shall urge the people participating in collective religious activities to abide by Chinese laws, rules and relevant provisions and not to hinder the normal life and working order of residents and units in the neighborhood while holding collective religious activities.
The congregant shall, at regular interval, report to the local district/county RAD on the situation of changes in the personnel participating in collective religious activities, and the implementation of all managerial system related thereto, etc.
Article 9(Date of Implementation)
These Procedures shall become effective as of May 1, 2007.
