To optimize the dispute resolution model for business-related cases and further promote the resolution of corporate conflicts at their source, the Jing'an District People's Court and Shanghai Jing'an District Federation of Industry and Commerce (Jing'an District Chamber of Commerce) recently held a signing and plaque-awarding ceremony of the Framework Agreement on Connection Mechanism between Chamber of Commerce Mediation and Litigation at the Shanghai Shibei High-tech Park. Sun Jing, Secretary of the Leading Party Members Group and President of the Jing'an District People's Court, attended the event.
The event emphasized that the agreement signing between Jing'an District People's Court and Shanghai Jing'an District Federation of Industry and Commerce, along with the establishment of mediation sub-centers, represents a further deepening of the previous cooperation between the two institutions and serves as a practical measure to implement the connection mechanism between the chamber of commerce mediation and litigation at the grassroots level. The establishment of the first four workstations for the chamber of commerce mediation indicates that Jing'an's connection mechanism between the chamber of commerce mediation and litigation has entered the fast track. The initiative aims to further maximize the advantages of the chamber of commerce mediation, and based on judicial practice, gradually develop replicable experiences to contribute a Jing'an Model for collaborative social governance between courts and federations of industry and commerce.
The event introduced four key features of Jing'an District's connection mechanism between the chamber of commerce mediation and litigation: resource integration and collaborative cooperation; expert aggregation and professional support; mediation priority with legal backing; and case-based legal education and risk resolution.
The Shibei Hi-tech Group stated that they will build bridges to establish a multi-channel, convenient, and multi-level dispute settlement system. Relying on the government-enterprise service center, they will provide businesses with intensive, intelligent, and efficient mediation services, actively creating a strong atmosphere for legal mediation of commercial disputes.
At the event, the Jing'an District People's Court and Shanghai Jing'an District Federation of Industry and Commerce jointly signed the Framework Agreement on Connection Mechanism between Chamber of Commerce Mediation and Litigation.
The attending leaders jointly unveiled the "Commercial Dispute Mediation Sub-center" and presented plaques to the first batch of four pilot units, including the "Mediation Workstation of the Chamber of Commerce in Shanghai Shibei High-tech Park", and issued certificates to mediators.
The meeting proposed three points for further improving the connection mechanism between the chamber of commerce mediation and litigation. Firstly, there is a need to further improve the "court + federation of industry and commerce" communication and collaboration mechanism to consolidate the joint efforts in diversified dispute resolution. This includes perfecting supporting policies, refining specific measures, strengthening horizontal coordination, and leveraging mediators' advantages in specific cases. Secondly, it is important to further activate the governance potential of the chamber of commerce mediation and enhance enterprises' "sense of satisfaction". This involves strengthening policy publicity and interpretation, widely establishing the concept of "mediation first", and promoting collaborative governance for identified industry-related risks. Third, the efforts should continue to strengthen the service capacity of the chamber of commerce mediation to better support broader goals and ensure justice for the people. Considering Jing'an's regional characteristics such as an export-oriented economy, more specialized, branded, and internationalized dispute resolution services will be provided. This includes exploring the establishment of connection mechanisms for the chamber of commerce mediation and litigation specifically for cross-border trade disputes.
Moving forward, the Jing'an District People's Court will further implement the "Fengqiao Experience" in the new era, adhering to "prioritizing non-litigation dispute resolution mechanisms". This aims to achieve efficient, convenient, low-cost, and substantive resolution of various business-related disputes, helping enterprises reduce costs and litigation burdens. It will inject judicial momentum into optimizing the law-based business environment, striving to provide legal guarantees for Jing'an District to create a model urban district of Chinese modernization.
