I. The Context of the Issuance of the Implementation Opinions
By fully implementing the guiding principles from the Party’s 20th National Congress, adhering to the principle that “housing is for living in, not for speculation”, and acting on the principle that “the people’s cities are built by the people and for the people”, the Implementation Opinions aim to accelerate the government-subsidized rental housing work of Jing’an District, improve the system of management and service for government-subsidized rental housing, enhance work coordination and resource integration, advance the management and service after the supply of government-subsidized rental housing, and alleviate housing difficulties for new urban residents and young people.
II. The Policy Basis for the Issuance of these Implementation Opinions
These Implementation Opinions are formulated in accordance with the guiding principles of the Opinions of the General Office of the State Council for Accelerating the Development of Government-Subsidized Rental Housing (SC G [2021] No. 22), the Implementation Opinions on Accelerating the Development of Government-Subsidized Rental Housing in Shanghai Municipality (SMPG GO D [2021] No. 12), the Administrative Measures of Shanghai Municipality for the Renting of Government-Subsidized Rental Housing (for Trial Implementation) (SMCHURD D J [2022] No. 3), and the Regulations of Shanghai Municipality on Housing Leasing, and in light of the actual circumstances of Jing’an District.
III. The Main Contents and Highlights of the Implementation Opinions
The Implementation Opinions clearly define the contents and requirements of the post-supply management and service for the government-subsidized rental housing in Jing’an District, covering four areas: guiding principles, working principles, main tasks, and work requirements.
The Implementation Opinions explicitly define the respective management responsibilities of all relevant units involved in the operation and management of government-subsidized rental housing. For example, the Implementation Opinions clarify the mechanism for the responsibilities among the four parties: The rental units shall fulfill the primary responsibilities for rental operation, the District Housing Security and Real Estate Management Bureau shall undertake the industry management responsibilities, various administrative functional departments shall fulfill relevant management responsibilities according to their functions, and the sub-district offices and towns shall implement their territorial management responsibilities.
The Implementation Opinions propose three major service measures, namely, leveraging the leading role of Party building to solve management challenges, expanding supporting measures to create a comfortable living environment, and starting with empowering technology to expand service channels. These three innovative measures will be adopted to strive to establish government-subsidized rental housing projects which feature standardized management and high-quality services.
IV. Way of Carrying out the Implementation Opinions
The drafting and issuance of the Implementation Opinions is an important measure to implement the policy of the District Party Committee and the District People’s Government of improving the management and service system for government-subsidized rental housing and promoting the post-supply management and service for government-subsidized rental housing. The District Housing Security and Real Estate Management Bureau shall work together with relevant units to properly interpret and carry out the Implementation Opinions. All relevant units shall, in accordance with the Implementation Opinions, provide orderly and compliant management and service for the government-subsidized rental housing in Jing’an District.
V. Specific Measures to Be Adopted by the Rental Units in Fulfilling Their Primary Responsibilities for Rental Operation
Under the guidance of the District Housing Security and Real Estate Management Bureau, the rental units shall standardize the supply and management of government-subsidized rental housing in accordance with the Regulations of Shanghai Municipality on Housing Leasing, the Notice on Further Strengthening the Management of Application, Supply and Operation Services for Government-Subsidized Rental Housing in Shanghai Municipality, and relevant provisions on rental management.
Firstly, the housing rental units shall implement systems for fire protection, flood control, typhoon prevention, safety inspections, training, and emergency drills. They must strengthen population management and routine safety management, and conduct self-inspections at least once a month to ensure that the management of government-subsidized rental housing projects is standardized and that no safety accidents occur.
Secondly, the housing rental units shall fulfill the public security and population management requirements for government-subsidized rental housing, as well as their responsibilities such as housing maintenance, repair, and fire safety.
VI. Specific Measures to Be Adopted by the District Housing Security and Real Estate Management Bureau to Fulfill its Industry Management Responsibilities
The District Housing Security and Real Estate Management Bureau shall carry out industry management, standardize the supply and use of government-subsidized rental housing, and orderly conduct the application and supply process for such housing.

Secondly, the Bureau shall work together with local sub-district offices and the district urban administrative and law enforcement department to further establish and improve the mechanism for joint routine on-site inspections and patrols. They shall jointly carry out routine and ad hoc inspections and patrols on rental units, surrounding intermediary agencies, lessees, residents, and users, and publicize relevant policies and provisions.
Thirdly, when identifying any problems during inspections, patrols, and daily management, the Bureau shall manage jointly with relevant district departments in accordance with the Notice on Further Strengthening the Management of Application, Supply and Operation Services for Government-Subsidized Rental Housing in Shanghai Municipality.
Fourthly, the Bureau shall effectively coordinate to promote, supervise and guide the government-subsidized rental housing work. It shall take the lead in formulating management and service systems, and coordinate various issues during the process. It shall also take the lead, as stipulated, in implementing preferential policies such as access to residential water and electricity rates.
VII. Other Administrative Functional Departments’ Administrative Responsibilities in the Management and Service for Government-Subsidized Rental Housing
The public security department is responsible for public order and population management in housing rental.
The market regulation department is responsible for the registration of market entities in housing rental and for investigating and punishing illegal activities involving housing rental, such as unfair competition, monopolies, and violations of advertising or pricing laws..
The departments of reform and development, planning and natural resources, economy and informatization, finance, taxation, financial regulation, civil affairs, emergency management, urban administration and law enforcement, education, human resources and social security, cyberspace administration, etc. as well as the fire rescue agency shall, according to their respective functions, carry out the routine management work. They shall carry out priority inspections on projects with prominent problems identified during the sub-district and town inspections and patrols, and investigate and penalize acts which are in violation of laws, rules or regulations in accordance with their respective functions.
VIII. Measures to Be Adopted by Sub-districts and Towns in Implementing Territorial Management
Firstly, the sub-districts and towns shall ensure that the management of government-subsidized rental housing is assigned to specific individuals. Leveraging the urban operation grid system and the Integrated Online Administration platform, they shall establish a filing system for government-subsidized rental housing projects within their jurisdictions. Within the grid, the departments of comprehensive governance, public security, urban management and law enforcement, etc. play the role of “a single grid” to establish and improve a joint-action management mechanism for government-subsidized rental housing, and conduct at least one special inspection per quarter on the use and management of the housing projects. For projects with safety hazards, or acts in violation of law, rules or regulations, they shall urge the operating enterprises to make timely rectifications and incorporate these into dynamic management, thus strengthening supervision over the projects. They shall also supervise the villagers’ committees and neighborhood committees to perform their management and service work well so that these committees can, in case of prominent problems identified during inspections, activate the joint response mechanism, coordinate with relevant functional departments, and carry out coordinated handling work.
Secondly, the villagers’ committees and neighborhood committees shall clearly designate management commissioners for government-subsidized rental housing. The committees shall incorporate both stand-alone and concentrated government-subsidized rental housing projects into the communities’ unified management with reference to the residential quarters; and the committees shall designate staff members to serve as management commissioners. With regard to the projects of converting non-residential buildings into residential buildings, the local villages and neighborhood communities may, according to the grid division of the local sub-districts, towns, villages and neighborhood communities, designate staff members to serve as management commissioners, who can work together with the project operating enterprises to fulfill their responsibilities for organizing and mobilizing, publicity and liaison, information gathering, self-inspection, problem discovery, and preliminary handling, among others.
IX. Specific Contents in the Service for Government-Subsidized Rental Housing
Firstly, in terms of the leading role of Party building, the local villagers’ committees and neighborhood committees shall investigate the situation of Party members in the government-subsidized rental housing projects within their jurisdiction and proactively promote the establishment of Party branches or Party groups. These committees shall collaborate with the project operating enterprises, property management companies and relevant government functional departments to jointly participate in community governance, and carry out consultative discussions focusing on the service matters of concern to the tenants within the project. They shall also establish service stations such as Party building and Youth League building contact points, and care stations, to give Party members living in the housing project a sense of fulfillment, happiness and belonging.
Secondly, in terms of expanding the supporting measures, in accordance with the service principle of “living with peace of mind and enjoying life with contentment,” the supportive public service spaces, and the community comprehensive service resources within 15 minutes’ walking distance shall be fully integrated to meet the living needs of the tenant groups in terms of socializing, exercising and entertainment. Policies for basic public services such as residence permit processing, and compulsory education for minor children residing with the permit holders shall be implemented.
Thirdly, in terms of expanding the service channels, a smart platform shall be built, a database for the residents established, and data information refined based on the District’s government-subsidized rental housing system so that the local villages and neighborhood communities can dynamically monitor the actual situation of the residents, and also tenants can voice their service requests on the smart platform simultaneously.
