In accordance with the Several Opinions of the Shanghai Municipal People’s Government on Promoting the High-Quality Development of the Health Service Industry and Accelerating the Construction of a Top-tier Medical Center City, the Opinions on Optimizing the Establishment and Management of Private Medical Institutions in This Municipality, and the Jing’an District Medical Institution Establishment Plan during the 14th Five-Year Plan Period, and in light of the current development of medical resources in the District, our Commission has formulated the Guidelines for the Establishment of Private Medical Institutions in Jing’an District (2025 Edition). Following review and approval by Jing’an District People’s Government, this document is hereby promulgated for your reference and implementation.

To better implement the important concept of “The city is built by the people and for the people” and thoroughly implement the important idea of “putting people first,” further consolidate and deepen the “separation of licenses and certificates” reform, standardize the registration and approval process for private medical institutions, and enhance transparency and predictability, the Guidelines for the Establishment of Private Medical Institutions in Jing’an District (2025 Edition) have been developed in accordance with the Opinions on Optimizing the Establishment and Management of Private Medical Institutions in This Municipality, and the Jing’an District Medical Institution Establishment Plan for the 14th Five-Year Plan Period (JDHC G [2022] No.15), and other documents.
I. General Requirements
Guided by Xi Jinping Thought on Socialism with Chinese Characteristics for a New Era, we will thoroughly implement the spirit of the 20th National Congress of the Communist Party of China and prioritize protecting people’s health, implement the Party’s guidelines on health and wellness in the new era, prioritize people’s health, and, based on the region’s specific circumstances and functional positioning, scientifically plan and rationally allocate the scale, structure, and layout of private medical resources, promote the expansion of high-quality medical resources and their balanced regional distribution. We will adhere to “planning” guidance, follow the principles of “protecting basic needs, strengthening grassroots organizations, and establishing mechanisms,” fully mobilize the initiative of market entities, support and guide the healthy development of private medical institutions of all levels and types, with diverse affiliations, business natures, and ownership forms, and build a diversified, well-structured, scientifically-planned, and ecologically sound private medical service system to meet the comprehensive and life-cycle health needs of the public.
II. Basic Principles
1. Openness and inclusiveness, with a focus on quality. In accordance with the overall requirements of the “streamlining administration, delegating power, and improving regulation and services” reform, we will emancipate the mind, optimize the policy support system and business environment, and gradually increase the opening up of the health services market. With a focus on healthcare and health services, we will continuously optimize the development, service, and legal environment for private medical institutions, give full play to the market’s leading role in the allocation of medical service resources, encourage the introduction of private capital with strong development potential and considerable brand value to Jing’an District, and establish high-quality, specialized, chain-based, and large-scale private medical institutions, thereby continuously enhancing the competitiveness and brand effectiveness of regional private medical institutions.
2. Comprehensive coordination and diversified development. We will pursue a vision on the functional positioning of an excellent global city, and promote the diversified development of the health service industry. While prioritizing medical quality and safety, safeguarding the health of the people, complying with relevant national laws, rules and regulations, and adhering to basic principles of medical ethics, we will proactively adapt to the current economic development situation in our district, fully open up the health industry market, and guide private capital to establish diversified private medical institutions that are aligned with the stage and level of socioeconomic development and meet the health service needs of various populations.
3. Strengthened supervision and orderly development. We will further deepen the reform of the administrative approval system, establish a standardized access approval mechanism, adhere to the implementation of the “double publicity” system, strengthen proactive information disclosure, improve the transparency of administrative approvals, and actively accept public supervision. We will adhere to the principle of “the approving authority is held accountable”, strengthen the medical quality and safety management of private medical institutions, implement on-site and post-event supervision responsibilities, establish and improve the exit mechanism, promote the formation of a closed-loop management cycle of “access-supervision-exit,” and promote the sustainable and healthy development of the health service industry.
4. Prioritized efficiency and strengthened services. We will strengthen the “navigation” attributes of the Establishment Guidelines, and adjust the regional divisions and establishment lists in a timely manner according to actual conditions. Under the premise of complying with the district health and wellness development plan and the district medical institution establishment plan, we will implement annual dynamic management of the Establishment Guidelines, closely combining the social and economic development status of Jing’an District, the changes in regional medical service demand, the market trend of the health service industry, and the operating quality, efficiency and benefits of private medical institutions. At the same time, we will pay attention to the scientific nature and effectiveness of the Establishment Guidelines, strengthen pre-service and guidance for private medical institutions, and avoid disorderly and ineffective investment of social capital.
III. Regional Classification and Demarcation
Based on the economic and social development goals and tasks of the District Party Committee and the District People’s Government, and in light of the current allocation of regional medical resources, we divide Jing’an administrative district into four categories. Private entities may independently choose to invest in and establish private medical institutions in corresponding areas. The classification principles and scope are as follows:
Category A Areas (Headquarters Cluster for High-quality Health Services Industry): These areas refer to areas where the government encourages the development of the health service industry. These include: the Suhewan Waterfront Business Cluster (east to Luofu Road and Henan North Road, west to Suzhou Creek, Anyuan Road, and Jiangning Road, south to Xinzha Road (west of Shimen 2nd Road) and Beijing West Road (east of Shimen 2nd Road), and north to the railway line); the Shibei High-Tech Service Industry Park (east to Sitang, west to Pengyuepu River, south to Wenshui Road, and north to Zoumatang, Gonghexin Road, and Changzhong Road); the Daning Industrial Park (north of Lingshi Road, east to Gonghexin Road, and west to Pengyuepu); and other “health service industry parks” newly planned and constructed by government departments such as the District Development and Reform Commission and the District Planning and Natural Resources Bureau.
Category B Areas (Expansion Zones for Premium Health Service Enterprise): These areas are characterized by relatively abundant medical resources and a comprehensive range of medical institutions. These areas are able to meet the basic medical needs and diversified health service needs of diverse populations. These areas include Nanjing West Road Sub-district, Jing’an Temple Sub-district, Caojiadu Sub-district, Jiangning Road Sub-district (west of Jiangning Road), Shimen 2nd Road Sub-district (south of Xinzha Road and west of Shimen 2nd Road, south of Beijing West Road and east of Shimen 2nd Road), and Daning Road Sub-district (west of Gonghexin Road and south of Daning Road). These areas have a high concentration of tertiary A-grade hospitals, specialized hospitals, and regional medical centers, and a well-established network of community health service centers and stations.
Category C Areas (Demonstration Zones for Health Service Brand Enhancement): These areas are characterized by an uneven distribution of medical resources and a relatively homogenous range of medical institutions. While the basic medical needs of the surrounding population are largely met, a diversified health service system is still underdeveloped. These areas include Tianmu West Road Sub-district (north of the railway), Zhijiang West Road Sub-district, Baoshan Road Sub-district, Gonghexin Road Sub-district, and Daning Road Sub-district (excluding areas west of Gonghexin Road and south of Daning Road). Community health service centers and stations in these areas generally meet needs, but there is a lack of top- tertiary general hospitals, a limited number of specialized hospitals, and the distance to regional medical centers is relatively long.
Category D Area (Introduction Area for Quality Specialized Health Service) refers to areas with a large population base and a high demand for medical resources. These areas include Pengpu Town, Pengpu Xincun Sub-district (excluding the area between Beijiao Station and Changzhong Road), and Linfen Road Sub-district (excluding the area between Beijiao Station and Changzhong Road). These areas are vast and have large permanent populations. Tertiary and specialized hospitals are largely absent, regional medical centers have insufficient coverage, and medical services are relatively weak. The distribution of community health service centers and stations is relatively uneven, and they cannot fully meet the medical service needs of surrounding residents.
IV. Support, Encouragement, and Restrictive Measures
The Opinions on Further Improving the Medical and Health Service System, issued by the General Office of the CPC Central Committee and the General Office of the State Council, requires governments at all levels to prioritize the development of a high-quality and efficient medical and health service system and include it in government work and assessment objectives. They should formulate specific implementation plans, execute various tasks, and strengthen institutional and mechanism innovation based on local conditions. To resolutely implement the Central People’s Government’s directives and deepen the “streamlining administration, delegating powers, and improving regulation” reform measures, further stimulate the passion of all healthcare professionals and various economic entities interested in the healthcare sector to pursue entrepreneurship, unleash market vitality and social creativity, and guide social forces in an orderly manner to actively invest in and establish medical institutions, we hereby have formulated the following support, encouragement, and regulatory measures in accordance with the Opinions on Further Improving the Medical and Health Service System, the Several Opinions on Promoting High-Quality Development of the Health Service Industry and Accelerating the Construction of a Top-tier Medical Center City, and the Opinions on Optimizing the Establishment and Management of Private Medical Institutions in This Municipality:
1. Provide strong support for the accelerated development of the life and health industry. During the 14th Five-Year Plan period, Jing’an District will focus on building a comprehensive health industry ecosystem, planning and constructing a high-standard Jing’an Comprehensive Health Industry Park, and creating a headquarters base for medical and health enterprises. Priority will be given to supporting the development of private medical institutions related to Jing’an District’s life and health industry planning objectives.
2. Encourage and support investors with a good social credibility, extensive experience in medical service management, and a certain scale and unique characteristics to establish high-quality, specialized, chain-style, and large-scale private medical institutions.
3. Vigorously promote traditional medicine, such as Traditional Chinese Medicine (TCM) and ethnic medicine, safeguard and promote the development of TCM, and support social forces with the ability and high-quality TCM resources to establish TCM or ethnic medicine institutions.
4. Encourage the establishment of high-quality medical institutions and service industry headquarters enterprises, as well as flagship demonstration sites for medical institutions, in Class A and Class B areas. We will support the establishment of high-end general practice medical institutions in Class A areas, encourage high-quality branded family doctor service teams to provide services, and support the establishment of independent pathology diagnosis centers, rehabilitation centers, nursing centers, disinfection supply centers, health checkup centers, and other high-quality medical institutions with headquarter-type, research-oriented, and outward-oriented services, provide services to the entire district, whole city, and nationwide. We will support the establishment of high-quality elderly care and TCM medical institutions in Class B areas. We will support market entities with a certain scale and mature management experience to establish high-end medical institutions with a total investment of over 100 million yuan and establish wholly foreign-owned hospitals in accordance with relevant documents. We will encourage the establishment of well-known domestic and international branded specialized medical institutions in Traditional Chinese Medicine, elderly care, pediatrics, sports medicine, rehabilitation medicine, and mental health in Class C and Class D areas. We will support branded family doctor service teams to develop and optimize basic medical services in the region.
5. In principle, we will suspend the acceptance of applications for medical aesthetics (including the establishment of medical aesthetics departments within other types of medical institutions) and general hospitals, and control the number of approvals for medical institutions in the dental and dermatology categories.
6. In accordance with the National Health Commission’s Interim Measures for the Registration and Management of Clinics (NHC MA G [2022] No.33), the establishment of clinics shall be subject to a registration system. In case that the establishment of clinics is not regulated by these Establishment Guidelines, the relevant management requirements will be formulated separately.
7. Institutions that engage in any of the following illegal medical practices, medical quality or safety issues such as fraudulent activities against patients or insurance schemes; or other acts of dishonesty or unethical conduct or bankruptcy or unauthorized cessation of practice will be strictly subject to the Shanghai Medical Institution Unfair Practice Scoring Management Measures. In serious cases, the medical institution’s license will be revoked in accordance with law.
V. Supplementary Provisions
1. The premises selected for the proposed establishment of a medical institution must be legally compliant buildings for medical, commercial, or retail purposes. Applicants must provide valid property documents (certificates) with clear ownership rights and the premises must comply with relevant requirements of government administrative departments such as health, market supervision administration, planning and natural resources, ecological environment, construction management, and fire rescue.
2. Private medical institutions should possess health information management capabilities. Their information systems must be able to connect with information management platforms such as those of health administrative departments and medical quality management departments, enabling the interconnection and interoperability of relevant business and management information.
3. Applicants must submit relevant applications in good faith. Dishonest behavior such as providing false materials or concealing relevant facts during the application process will be recorded in their integrity records.
4. Applicants must pay taxes in accordance with relevant national and municipal laws, rules and regulations and Jing’an District administrative regulations.
5. During this period, the establishment and approval of non-profit medical institutions other than clinics will be governed by these Establishment Guidelines. Relocations of existing medical institutions should, in principle, be located within the same area as defined in these Establishment Guidelines. Cross-regional relocations should, in principle, be regulated by these Establishment Guidelines. Internal medical institutions established by government agencies, enterprises, public institutions, and nursing homes for “internal” purposes are not subject to the regulatory approval number requirements of these Establishment Guidelines.
6. The establishment of medical institutions and related construction projects involved in the overall work and annual key tasks of the Jing’an District Party Committee and District People’s Government are not subject to the regulatory requirements of these Establishment Guidelines.
7. These Establishment Guidelines will be updated and publicly released annually. This version of Establishment Guidelines is valid from the date of publication until December 31, 2025. In the event of any inconsistency between previous provisions and these Establishment Guidelines, these Establishment Guidelines shall prevail.
8. Jing’an District Health Commission is responsible for interpreting these Establishment Guidelines.

I. The establishment entity must be an enterprise related to the health services industry. The permitted “business scope” must include (but not be limited to) medical services, clinic services, health services, medical management, medical investment, and other related projects.
II. The establishment entity may only apply to establish medical institutions for which the national and municipal governments have published basic standards.
III. In principle, newly established medical institutions must maintain an appropriate distance from similar surrounding medical institutions. Medical institutions must maintain a reasonable distance from childcare centers, primary and secondary schools, and food processing or manufacturing enterprises. Mixed-use property for business and living (including commercial premises located within the podium of residential buildings) and properties with a straight-line distance of less than 50 meters from residential buildings generally will not be accepted. Hospitals should, in principle, be established in standalone buildings.
IV. Newly established medical institutions must meet the relevant requirements of the Basic Standards for Medical Institutions promulgated by the State or Shanghai Municipality. Based on this, and taking into account the specific circumstances of the District, the following basic standards are recommended for some common medical institutions.
1. Specialized Hospitals: Other specialized hospitals must have ≥50 inpatient beds; dental hospitals must have ≥40 inpatient beds and ≥30 dental chairs. The floor area of hospital space must comply with the relevant national Basic Standards for Medical Institutions and Construction Standards.
2. Nursing Homes: Number of nursing beds ≥ 100, total investment ≥ 50 million yuan; the floor area of nursing home space shall comply with the Basic Standards for Nursing Homes (2011 edition) and refer to the Construction Standards for general hospitals of the same rank.
3. Outpatient Departments: General outpatient departments shall have a floor area of 1,000 m²; specialized outpatient departments (excluding dental clinics) shall have a business floor area ≥ 800 m². Dental clinics shall have ≥ 6 dental chairs, with each dental treatment unit sharing a floor area ≥ 60 m². The internal usable area of dental treatment rooms shall be ≥ 10 m², and each treatment room may only have one dental chair. Outpatient operating rooms, dental implant rooms, etc. shall be divided into “three zones,” with the internal usable area of the operating room (implantation room) ≥ 25 m².
4. Principles for staffing of health technical personnel in medical institutions of all levels and types: First-level specialist hospitals require ≥3 associate chief physicians and above, at least 1 attending physician and above physician in each clinical department, ≥1 nurse with associate chief nurse and above, ≥2 head nurses, ≥1 head technician and above technician, ≥1 head laboratory technician and above laboratory technician, ≥1 head pharmacist and above pharmacist, and ≥1 clinical nutritionist;
Second-level specialist hospitals require ≥4 associate chief physicians and above, at least 1 attending physician and above physician in each clinical department, ≥1 nurse with associate chief nurse and above 1, ≥3 head nurses, ≥1 head technician or above technician, ≥1 head laboratory technician or above laboratory technician, ≥1 head pharmacist or above pharmacist, ≥1 clinical nutritionist;
Comprehensive outpatient departments require ≥2 deputy chief physicians or above physicians, each clinical department must have at least 1 attending physician and above physician, ≥2 head nurses or above nurses, and ≥2 other health technicians with intermediate professional titles or above; specialist outpatient departments require ≥1 deputy chief physician or above physicians, each clinical department must have at least 1 attending physician and above physician, and ≥2 head nurses or above nurses. All doctors and nurses should complete their professional registration within three months after obtaining the Medical Institution Practice License, and other health technicians should be hired before obtaining the Medical Institution Practice License.
5. In principle, the establishment of Traditional Chinese Medicine (TCM) medical institutions (excluding Level II and above TCM hospitals) is not subject to planning or quantity restrictions. The business space requirements for TCM medical institutions may be relaxed appropriately based on reference to medical institutions of the same rank.
6. Newly established medical institutions must meet basic requirements for information management. In accordance with the National Health Commission’s Guidelines for Application Functions of Hospital Information Platforms, Guidelines for Application Technology of Hospital Information Construction, and the Shanghai Municipal Health Resources and Medical Services Survey System, all medical institutions must establish corresponding information management platforms and have access to the Jing’an District Medical Service Supervision Network Information System.
7. Prior to submitting the Application for Medical Institution Practice Registration and relevant supporting materials, a newly established medical institution must undergo a public notification process of its relevant practice information, as organized by the health administrative department. If complaints or objections are received during the public notification period, they shall be handled in accordance with the Regulations on Petitions and other relevant regulations. In principle, the practice application shall not be accepted, or its approval shall be suspended (or terminated), until the resolution of such matters.
