In order to fully implement the guiding principles of General Secretary Xi Jinping’s important speech at the private enterprise forum and the spirit of Shanghai’s conference on promoting the high-quality development of the private economy, and to execute the Several Measures for Promoting the High-Quality Development of the Private Economy in the New Journey of the New Era, the following measures are proposed to foster the high-quality development of the private economy in Jing’an District.

I. Creating a Fair Competition Market Environment

1. Strictly Implementing the Negative List for Market Access.We, Jing’an District, will implement the management requirement of “a single national list,” advance the investigation and removal of market access barriers, and ensure that, beyond the list, there are no additional market-access administrative approvals or restrictive conditions established in violation of the regulations.(Responsible unit: the District Market Supervision Administration)

2. Strictly Enforcing the Fair Competition Review System.We will conduct fair competition reviews on policy measures and normative documents related to the economic activities of business entities in accordance with law. We will establish mechanisms for accepting, handling, and addressing complaints and reports regarding fair competition reviews.(Responsible units:the District Market Supervision Administration, and relevant units)

3. Ensuring Openness, Fairness, and Impartiality in the Entire Process of Construction Project Bidding.We will promote the institutionalization and intelligentization of bidding supervision; advance the smart supervision of bid evaluation projects, and fully implement on-site decentralized bid evaluation and remote decentralized bid evaluation.We will further standardize market practices in construction projects and strengthen the oversight of bid qualification threshold settings.(Responsible unit: the District Construction Management Commission)

4. Supporting Small and Medium-sized Enterprises in Participating in Government Procurement.We will strictly implement policies that promote the development of small and medium-sized enterprises (SMEs) in government procurement, and effectively utilize measures such as reserved procurement quotas and price evaluation preferences, to increase the bid-winning rate of SMEs in government procurement.(Responsible unit: the District Finance Bureau)

II. Increasing Investment and Financing Support for Private Enterprises

5.Encouraging Private Enterprises to Expand Investment.We will strengthen guidance and services for private enterprises participating in the “Two Major Initiatives for Major National Strategies and Key Security Areas” and “Two New Programs for Equipment Updating and Consumer Goods Trade-ins”. Private enterprises will be supported in investing in key economic and social fields and emerging industrial sectors. A key project database will be established for private investment. Government investment funds and industrial support funds will be encouraged to back private investment projects.(Responsible units: the District Development and Reform Commission, and relevant units)

6. Guiding and Supporting Private Investment in Key Sector Development.Private capital will be guided to participate in the construction and operational management of projects in areas such as government-subsidized rental housing. Private enterprises are supported in engaging in green construction, and the application of technologies like blockchain is encouraged to develop scenarios for green and low-carbon transformation. Capable private enterprises are encouraged and guided to apply for pilot projects of innovative development of trusted data spaces.(Responsible units: theDistrict Development and Reform Commission, the District Housing Security and Real Estate Management Bureau, and the District Data Bureau)

7. Enhancing Bank Credit Support.Banks within the District are encouraged to increase credit allocation to private enterprises. They are also urged to innovate financial products and service models. The role of the coordination mechanism for financing micro and small enterprises and the credit service platform will be leveraged, encouraging financial institutions to provide SMEs with the services of “seamless loan renewal” and “renewal without repayment”. Efforts will be made to increase the coverage and effectiveness of “batch loans for business associations,” increase the scale and scope of policy-based financing guarantee funds formicro, small and medium-sized enterprises, and strengthen fiscal support for SMEs through interest and fee subsidies for policy-backed guaranteed loans.(Responsible units: the District Investment Service Office, the District Finance Bureau, the District Development and Reform Commission, and the District Federation of Industry and Commerce)

8. Facilitating Private Enterprises’ Access to Multi-Tier Capital Markets.We will refine the listing service mechanism to support private enterprises in raising funds through various capital market tiers, including the Sci-Tech Innovation Board (STAR Market), ChiNext, and the Main Board. By integrating resources from securities companies and professional service institutions within the District, we will establish cooperation and exchange platforms to help private enterprises secure capital market support through diverse channels. The strengths of the equity investment agglomeration zone will be utilized to promote linkages between upstream and downstream players in industrial chains and facilitate the alignment of industrial capital.(Responsible units: the District Investment Service Office, and relevant units)

9. Encouraging High-Quality Mergers and Acquisitions by Private Enterprises.We will vigorously promote the development of M&A clusters, encouraging private enterprises to undertake M&A activities focused on strengthening and supplementing chains in new quality productive forces and upgrading traditional industries. We will enhance M&A service capabilities by providing private enterprises with one-stop services including professional consultancy, financing coordination, operational support, and post-investment management.(Responsible units: the District Investment Service Office, and the District Science & Technology and Economy Commission)

10. Accelerating Innovative Applications of “Blockchain + Finance”.A supply-demand matching platform will be established to encourage blockchain enterprises to develop innovative applications in areas such as credit financing, supply-chain finance, cross-border payments, and financial leasing. Leading enterprises will be supported in fully leveraging blockchain technology to develop supply-chain financial services. Private micro, small and medium-sized enterprises within supply chains will be supported in conducting businesses such as order-based loans, and private enterprises will be encouraged to engage in supply chain bill operations.(Responsible units: the District Investment Service Office, and the District Data Bureau)

11. Optimizing Intellectual Property Financing Services for Private Enterprises.Banks within the District are encouraged to innovate and launch products such as pledge loans and cross-border income loans based on intellectual property including trademarks, patents, and copyrights, thereby enhancing credit facilitation models for private enterprise financing. Banks in the District are also supported in establishing “specialized outlets for intellectual property pledge loans and applying for approval thereof.”(Responsible units: the District Investment Service Office, and the District Market Supervision Administration)

12. Improving the Comprehensive Financial Service System.We will promote the deeper integration of inclusive financial advisory services into small and medium-sized parks and office buildings, delivering personalized “service packages” to enterprises. The financing service centers will reach out to lower levels and achieve one-stop comprehensive financial services that benefit businesses and facilitate public access. With the help of the “Smart Assistance” system ofthe “Government Online-Offline Shanghai Jing’an flagship portal,one-on-one remote financing business consultations will be provided.(Responsible unit: the District Investment Service Office)

III. Vigorously Supporting the Innovative Development of Private Enterprises

13.Supporting Private Enterprises in Enhancing Their Capability as Sources of Innovation.Private enterprises will be supported in participating in major domestic and international technological R&D initiatives, as well as in tackling industrial generic technology challenges. They will also be supported in engaging in the development of innovation platforms such as key laboratories, new-type R&D institutions, and open innovation accelerators led by large enterprises. Private enterprises are encouraged to participate in the joint establishment of academician workstations and postdoctoral workstations.(Responsible units: the District Science & Technology and Economy Commission, and the District Talent Bureau)

14. Enhancing the Capabilities of Characteristic Industries in the Private Sector.We will advance the high-standard development of the national blockchain application demonstration zone (“Digital Hub & Blockchain Valley”), the Shanghai ultra-high definition audiovisual industry cluster (“Audio-Visual Jingjie”), and the skin health management innovation center (“Beauty & Innovation Jingjie”), aiming to build high-capacity industrial clusters within the private economy.(Responsible units:the District Data Bureau, the District Science & Technology and Economy Commission, the District Commerce Commission, Shibei Functional Zone, and Daning Functional Zone)

15. Cultivating a “Flying Geese Formation” of Innovative Private Enterprises.We will enhance the exemplary role of leading private enterprises as the “leading geese,” accelerate the tiered cultivation of “Specialized, Refined, Unique, and Innovative” enterprises, and promote collaborative innovation between leading enterprises and “Specialized, Refined, Unique, and Innovative” enterprises along the industrial chain. This will foster integrated development among large, medium-sized and small private enterprises. Additionally, we will establish digital transformation enabling platforms to provide professional service support in areas such as smart manufacturing and industrial internet.(Responsible unit: the District Science & Technology and Economy Commission)

16. Fostering a Pattern of Collaborative Development Between State-Owned and Private Enterprises.Support will be provided for collaborative innovation between private enterprises and resources such as medical institutions and research institutes, aiming to establish functional platforms for public R&D services, clinical medicine translation, and technological innovation incubation. In-depth cooperation between state-owned and private enterprises will be promoted in areas including supply chains and innovation chains. 17. Strengthening Services and Protection for Private Enterprises’ Intellectual Property (IP).IP support policies will be leveraged to encourage enterprises to intensify IP development. The role of the Shanghai Intellectual Property Protection Center Jing’an Branch will be utilized to provide fast-tracking patent pre-screening services to key private enterprises in accordance with  law, accelerating the transformation of scientific and technological achievements. The Jing’an District Patent Supermarket will be used to establish a comprehensive IP trading platform. The District will enhance protection of intellectual property, and continuously combat infringements in accordance with law. Pilot innovativeinitiatives for trade secret protection will be promoted, and administrative law enforcement for trade secret protection will be strengthened.(Responsible units: the District Market Supervision Administration, the District People’s Court, the District People’s Procuratorate, and the District Branch of Shanghai Public Security Bureau)

IV. Building a High-Quality Development Hub for the Private Sector

18. Vigorously Aggregating Headquarters and Functional Institutions of Private Enterprises.High-quality private enterprises are encouraged to grow larger and stronger, and a group of private enterprise headquarters will be attracted to and nurtured in Jing’an District. Private enterprises will be supported in establishing functional institutions in Jing’an District, such as R&D centers, global supply chain management centers, capital settlement centers, and trade headquarters. Support and services will be provided in areas including talent introduction, cross-border fund settlement, and data flow, to construct a bi-directionally open functional hub.(Responsible units: the District Commerce Commission, the District Science & Technology and Economy Commission, the District Talent Bureau, and the District Cyberspace Administration)

19. Building a Comprehensive Service Hub for Private Enterprises’ Global Expansion.The platform advantages of the Global Service Providers Council will be leveraged to launch initiatives such as the Outbound Alliance and Outbound Academy, providing integrated professional services for private enterprises to “go global”. Stronger policy support, including professional service vouchers, will be provided to assist private enterprises in continuously expanding overseas operations and optimizing their international footprint. 20. Enhancing the Cultivation of High-Quality Private Brands.Specialized policy support will be strengthenedto promote the agglomeration and development of renowned private brands in Jing’an District. Focusing on the debut economy and leveraging major festival and exhibition events, we will assist private brands in enhancing their market influence. Backstreet economy will be boosted to provide more growth space for private brands.(Responsible unit: the District Commerce Commission)

21. Building a Demonstration Zone for High-Quality Development of the Private Sector.We will capitalize on the historical advantages of Jing’an areas along the Suzhou Creek, the birthplaces of the modern national industry and commerce, with the former site of the Shanghai General Chamber of Commerce as a core landmark, to create the “Suhewan Private Economy Reception Hall.” This initiative aims to establish an influential government-enterprise communication hub, a resource-matching platform, and a private sector think tank. Additionally, we will accelerate the development of the Shibei Hi-Tech Private Enterprise Headquarters Agglomeration Area, building a private economy cluster hub characterized by “Cloud Computing, Big Data, Artificial Intelligence, and Blockchain.”(Responsible units: Suhewan Functional Zone, and Shibei Functional Zone)

V.Protecting the Legitimate Rights and Interests of Private Enterprises and Entrepreneurs in Accordance with Law

22. Continuously Clearing Arrears Owed to Small and Medium-sized Enterprises.A long-term mechanism for preventing and resolving overdue payments to SMEs will be established, and regular comprehensive inspections will be conducted. The building of a government procurement performance acceptance system will be strengthened. The regular mechanism for handling complaints related to overdue payments and for supervision and accountability will be refined.(Responsible units: the District Science & Technology and Economy Commission, the District State-owned Assets Supervision and Administration Commission, and the District Finance Bureau)

23.Enhancing Incentives for Good Credit and Punishment for Bad Credit.We will implement incentives for good credit and punishment for bad credit in accordance with law, and promptly update the information on the “Credit Shanghai (Jing’an)” website. We will conduct follow-up evaluations on government integrity, and incorporate instances of government departments’ bad credit into the evaluation system. We will also optimize the “One Simple Thing” function for public credit repair and explore “AI + Credit Repair.”(Responsible unit: the District Development and Reform Commission)

24. Strengthening Legal Safeguards for the Private Sector.We will protect the legitimate rights and interests of entrepreneurs in accordance with law, and strictly distinguish between economic disputes and criminal offenses. We will regulate and control profit-driven professional claims and reporting activities in accordance with law. When complaints are confirmed to be profit-driven professional claims, they may not be accepted, or the mediation may be terminated as per laws, rules and regulations. We will, in accordance with law, combat and address criminal activities such as those conducted by “professional rights defenders” and “professional store closers”. 25. Optimizing Administrative Inspections Involving Enterprises.We will comprehensively implement a tiered and categorized inspection system based on “risk + credit.” We will fully roll out the “Inspection Code” for administrative inspections involving enterprises to enhance the quality and efficiency of such inspections. Technologies such as big data and artificial intelligence will be used to reduce non-essential on-site inspections. A system for releasing reports on market supervision administrative law enforcement will be established.(Responsible units: the relevant district law enforcement departments, the District Development and Reform Commission, the District Bureau of Justice, the District Market Supervision Administration, and other relevant units)

26. Deepening Tolerant and Prudent Regulation.We will advance measures that exempt minor violations from penalties. By integrating a variety of means, we will have greater fault tolerance mechanisms in dealing with enterprises. A “guidance period” mechanism for start-up enterprises will be implemented, featuring “triggered supervision” during the one-year guidance period. We will optimize the supply of regulatory systems for neweconomy and forms of business to support the development of new business forms.(Responsible units: the District Market Supervision Administration, and the District Urban Administrative and Law Enforcement Bureau)

27. Regulating the Handling of Enterprise-Related Cases.We will strictly implement procedures for the disposal of property involved in cases, and prudently adopt compulsory measures and sanctions such as sealing and freezing. We will formulate detailed implementation rules regarding property preservation, apply prudent preservation measures for private enterprises, minimize the impact on their normal business operations, and allow the use of credit guarantee letters in lieu of physical collateral. We will optimize the review of cooperation requests from public security organs in other jurisdictions for criminal case handling, solidly advance special supervision of irregular cross-regional law enforcement and profit-driven judicial enforcement, and promote fairness and impartiality in cross-regional law enforcement. 28. Enhancing Legal Services for Enterprise Protection.We will upgrade the “Wei Qi” (Safeguarding Enterprises) Alliance for Preventing and Controlling Legal Risks in Economic Crimes, deepen the development of the online dedicated window “Hu Qi Guan Jia, Hu Qi You Wo” (Shanghai Enterprise Steward, Protecting Enterprises with Me), and advance the construction of the “Blue Whale” Enterprise Protection Workstations so as to improve risk prevention alerts for enterprises. We will implement prosecutorial measures to escort the law-based business environment, promote the establishment of legal service workstations in Zhangyuan Park and Shibei High-Tech Park, and enhance the “one-stop” enterprise protection services within the parks.(Responsible units: the District Branch of Shanghai Public Security Bureau, the District People’s Procuratorate, and the District People’s Court)

29. Fostering a Healthy and Clear Online Environment.We will carry out targeted campaigns to address issues such as the creation and dissemination of false or inaccurate information, and the coercion of enterprises into cooperation under the pretext of handling negative information. Concentrated efforts will be made to combat and penalize criminal activities involving the fabrication and spreading of rumors about enterprises. Severe penalties will be imposed in accordance with law against acts that severely impact business operations, such as the use of “internet water armies” to throw mud at corporate reputation, and the exploitation of platform vulnerabilities to maliciously reap profits.(Responsible units: the District People’s Procuratorate, the District Cyberspace Administration, and the District Branch of Shanghai Public Security Bureau)

VI. Effectively Strengthening Service Guarantees for the Development of the Private Sector

30. Improving Services Related to Pro-business Policies.The formulation of enterprise-related policies should extensively incorporate opinions from private enterprises and industry associations and chambers of commerce. The level of “Government Online-Offline Shanghai” should be elevated, and the two-way channel of “policies reaching out to enterprises and enterprises seeking out policies” should be expanded. The scope of policies that are “enjoyable without application” and “directly and quickly accessible” should be broadened. 31. Strengthening Support for Various Production Factors. We will promote the renewal and upgrading of commercial properties, the renovation of old office buildings, and the efficient use of industrial land to provide private enterprises with diverse space. We will enable outstanding professionals of private enterprises to attain higher professional titles through the “fast track” and “green channel.” Private enterprises are encouraged to collaborate with universities in establishing vocational training bases and cultivating talent through customized training programs.(Responsible units: the DistrictPlanning and Natural Resources Bureau, the District Commerce Commission, the District Science & Technology and Economy Commission, the District Investment Service Office, and the District Human Resources and Social Security Bureau)

32. Improving the Regular Communication and Exchange Mechanism with Private Enterprises. We will enhance the regular government-enterprise communication mechanism, strengthen the role of platforms such as joint meetings on private sector development and roundtable meetings with private enterprises, and hold regular or irregular seminars with private enterprises to continuously refine policies and measures. We will further integrate investment promotion and enterprise services, make good use of the “service package” system for key enterprises, and intensify efforts to identify and effectively resolve issues concerning enterprises.(Responsible units: the District Federation of Industry and Commerce, the District Development and Reform Commission, and the District Investment Service Office)

33. Strengthening Statistical Analysis of the Private Sector. Strengthening Organizational Support.We will establish and improve a working coordination mechanism of Jing’an District to promote the high-quality development of the private economy, ensuring the effective implementation of various tasks and measures.
