I. Background
To better implement the important concept of “The city is built by the people and for the people,” and firmly uphold the “people-centered” philosophy, further consolidate and deepen the “separation of licenses and certificates” reform, standardize the registration and approval process for private medical institutions, and enhance transparency and predictability, optimize the allocation of medical resources in Jing’an District, improve the efficiency of their utilization, promote diversified and multi-level healthcare provision by social forces, promote and serve the healthy development of high-quality medical resources, and meet the people’s growing demand for high-quality health services, we have developed the Guidelines for the Establishment of Private Medical Institutions in Jing’an District (2025 Edition) (hereinafter referred to as the “Establishment Guidelines”) in accordance with the Opinions of the State Council on Promoting the Pilot Program of the “Separation of Licenses and Certificates” Reform on a Larger Scale, the Several Opinions of Shanghai Municipal People’s Government on Promoting the High-Quality Development of the Health Service Industry and Accelerating the Construction of a First-Class Medical Center City, and the Opinions on Optimizing the Establishment and Management of Private Medical Institutions in the Municipality, and based on an objective evaluation of the effectiveness of the 2024 guidelines for the establishment of private medical institutions.
II. Development Process
After initiating the drafting of the Establishment Guidelines, our Commission conducted in-depth research to ensure alignment with the Jing’an District Medical Institution Establishment Plan for the 14th Five-Year Plan Period and other relevant district professional plans. After multiple rounds of revisions and improvements, we finalized the Establishment Guidelines (Draft for Comment).
Regarding the draft, we solicited opinions and suggestions from multiple administrative departments of the District People’s Government and the relevant functional district administrative departments. We also consulted with the District Social Medical Institutions Association and some private enterprises. Our Commission adopted the vast majority of the opinions and suggestions collected, and further revised and improved the Establishment Guidelines. To ensure the scientific nature, preciseness, and practicality of the Establishment Guidelines, after multiple rounds of public consultation, our Commission published the document on Jing’an District People’s Government official website for public comment.
Meanwhile, in order to ensure the legality of the Establishment Guidelines, our Commission organized the Legal Supervision Section, the Medical Administration Section, and our permanent legal counsel to conduct a legal review of the document. After review and deliberation, we all unanimously agreed that the Establishment Guidelines are complete in content, standardized in form, and focused on key points, demonstrating a high degree of legality, scientific nature, and feasibility.
III. Main Contents
1. Guiding Ideology and Basic Principles
Based on the actual conditions and functional positioning of the District, these Establishment Guidelines scientifically plan and rationally allocate the scale, structure, and layout of social medical resources. Adhering to the guidance of “planning” and following the overarching principles of “ensuring basics, strengthening grassroots, and building mechanisms,” we will fully leverage the initiative of market entities, support and guide the sound and healthy development of private medical institutions of various levels, affiliations, operational natures, and ownership forms. The aim is to build a diversified, private healthcare service system that is rationally structured, scientifically distributed, and ecologically sound, meeting the public’s comprehensive, full-cycle health needs. The following four principles must be adhered to during implementation:
First, adhere to the principles of openness and inclusiveness, with a focus on quality. Second, adhere to the principles of comprehensive coordination and diversified development. Third, adhere to fairness and justice, and strengthen supervision. Fourth, adhere to the principles of prioritized efficiency and strengthened services.
2. Regional Classification and Demarcation
To facilitate site selection for private medical institutions, based on the economic and social status and development goals of Jing’an District’s various functional areas, and in light of the regional allocation of medical resources, we divide Jing’an District’s administrative area in these Establishment Guidelines into four categories. Private institutions may independently select corresponding areas to invest in and establish private medical institutions. The classification principles and regional scopes are as follows:
First, Category A, primarily encompassing the Suhewan Functional Area, Shibei Functional Area, and Daning Functional Area. Second, Category B, primarily encompassing the area south of Suzhou Creek and portions of the Daning International Plaza area in Daning Road Sub-district. Third, Category C, primarily encompassing the areas of Tianmu West Road Sub-district (north of the railway), Zhijiang West Road Sub-district, Baoshan Road Sub-district, and Gonghexin Road Sub-district in central Jing’an District, as well as portions of Daning Road Sub-district. Third, Category D, primarily encompassing Pengpu Town, Pengpu Xincun Sub-district, and Linfen Road Sub-district in north Jing’an District.
3. Relevant Encouragement and Regulatory Measures
First, priority support will be given to the development of private medical institutions that align with the goals of Jing’an District’s life and health industry planning.
Second, we support investors with good social credibility, extensive experience in medical service management, and a certain scale and unique characteristics to establish high-quality, specialized, chain-style, and large-scale private medical institutions.
Third, we will vigorously promote traditional medicine, such as Traditional Chinese Medicine (TCM) and ethnic medicine, safeguard and promote the development of TCM, and support social forces with the ability and high-quality TCM resources to establish TCM or ethnic medicine institutions.
Fourth, we will encourage the establishment of high-quality medical institutions and service industry headquarters, as well as flagship demonstration sites for medical institutions, in Category A and B areas. We will encourage the establishment of well-known domestic and international specialized medical institutions in TCM, elderly care, pediatrics, sports medicine, rehabilitation medicine, and mental health in Category C and D areas. We will also support branded family doctor service teams to develop and optimize basic medical services in the region.
Fifth, in principle, we will suspend the acceptance of applications for medical aesthetics (including the establishment of medical aesthetics departments within other types of medical institutions), dermatology, and general hospitals, and control the number of approvals for institutions in the dental and dermatology categories.
4. Basic Conditions for Establishing a Medical Institution
First, the applicant must be legally qualified and meet the basic conditions for establishing a medical institution. The type of medical institution applied for must be within the scope announced by the State and the Municipality.
Second, the medical institution’s location must comply with regional planning requirements, the building must be legal and compliant, and comply with the Regulations on the Administration of Medical Institutions and the requirements of administrative departments such as construction management, and ecological environment. It must maintain an appropriate distance from educational institutions, food production and processing units, and similar medical institutions.
Third, on the basis of meeting the Basic Standards for Medical Institutions, and taking into account the actual conditions of the District and the need for high-quality development of medical institutions, applications for establishing certain categories of medical institutions that meet specified standards in technical capabilities, facility equipment, and basic hardware may be prioritized for approval, provided all other conditions are equal.
5. Planned Annual Approval Quota This Year
4 in Category A areas; 4 in Category B areas; 3 in Category C areas; and 3 in Category D areas.
